Summary

This bill has three purposes. First, to ensure that all persons that are convicted in the future of a sexual offense or sexually violent offense that is ultimately classified as a level two or level three risk would be subject to a life time mandatory supervision to minimize the risk of future violations of the law should such individuals later be released from incarceration. Second, it establishes a more closely monitored tracking system to facilitate law enforcement's ability to determine the whereabouts, movements and activities of level two and level three sex offenders within the community. In addition, it greatly shortens the period of time for re-registration and reverification of such individual's location and activities. Should such individuals fail to abide by the new criteria, the punishment for such failure would be life time supervision of all designated as a level two or three risk. Third, it establishes procedures to ensure that more level two or three individuals do not reside near or are placed near child risk centers such as schools, day care centers, or play grounds. Further, it attempts to avoid the over concentration of such persons in areas that do not have adequate professional services available or the physical layout required to provide for the financial, social, moral and psychological needs of such individuals to minimize the risk of a sexual re-offense. In addition, it prohibits the over concentration of such designated individuals in residential areas of any municipality or any portion of a municipality.
