Summary
The amendment to Section 1, subdivision 4 of section 125.20 of the penal law, "Manslaughter in the first degree", adds subdivision 5, which previously did not exist. It recites that a person is guilty of Manslaughter in the first degree when he or she "recklessly causes the death of another person by means of a deadly weapon or dangerous instrument". Section 3 adds a new subsection 125.24, which allows a defendant to be charged with Murder in the Second Degree "Intentional Murder" AND "Depraved Indifference Murder", giving the jury the option of finding the defendant guilty of either one or both.
