Summary

This bill amends the provisions of Penal Law Article 178 (Criminal Diversion of Prescription Medications and Prescriptions) to strengthen prosecution of pharmacists and others involved in criminal diversion of prescription medications or devices.

Title

Establishes the crimes of criminal possession of criminally diverted prescription medications and devices in the fifth, fourth, third, second and first degrees, establishes rebuttable presumptions with respect to such crimes.
