          reprinted, retaining its place on the order of third reading

        AN ACT to amend the arts and cultural affairs law, in relation to creat-
          ing arts and cultural districts

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  arts and cultural affairs law is amended by adding a
     2  new section 3.17 to read as follows:
     3    § 3.17. Arts and cultural districts. 1.   For  the  purposes  of  this
     4  section, "arts and cultural districts" means geographic areas of a city,
     5  town  or village with a concentration of non-profit institutions engaged
     6  in artistic and cultural  activities  including,  but  not  limited  to,
     7  music,  theatre,  dance,  painting,  sculpture, architecture, and allied
     8  arts and crafts.
     9    2.  The council shall develop criteria and guidelines for state desig-
    10  nated arts and cultural districts.  Criteria developed by the council to
    11  designate a district shall, to the extent practicable, include, but  not
    12  be  limited  to, determinations that such district: (a) attracts artists
    13  or cultural enterprises to the community, (b)  encourages  business  and
    14  job  development  due  to  the pre-existing institutions, (c) attracts a
    15  sufficient amount of tourism, (d) enhances  local  property  values  and
    16  fosters local cultural development, or (e) has the potential to meet any
    17  of  the  categorical  determinations  if  sufficient  state  support and
    18  assistance is provided to the proposed district. The council shall  also
    19  develop  guidelines  that provide assistance to a city, town, or village
    20  in developing an application for district certification.
    21    § 2. This act shall take effect on the one hundred twentieth day after
    22  it shall have become a law.
