DeSTEFA- NO, DICKENS, ENGLEBRIGHT, FERNANDEZ, SIMON -- read once and referred to the Committee on Energy AN ACT to amend the public service law, in relation to ensuring net metering is maintained as a compensation floor for residential produc- ers of energy The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 6 of section 66-j of the public service law, as 2 amended by chapter 355 of the laws of 2009, is amended to read as 3 follows: 4 6. Electric restructuring. Notwithstanding the provisions of this 5 section, including, but not limited to paragraph (b) of subdivision 6 three of this section, a customer-generator shall comply with any appli- 7 cable determinations of the commission relating to restructuring of the 8 electric industry. However, customer-generators shall never be compen- 9 sated at a value less than would exist under net energy metering. 10 § 2. Subdivision 6 of section 66-l of the public service law, as 11 amended by chapter 721 of the laws of 2006, is amended to read as 12 follows: 13 6. Electric restructuring. Notwithstanding the provisions of this 14 section, including, but not limited to paragraph (c) of subdivision 15 three of this section, a customer-generator shall comply with any appli- 16 cable determinations of the commission relating to restructuring of the 17 electric industry. However, customer-generators shall never be compen- 18 sated at a value less than would exist under net energy metering. 19 § 3. This act shall take effect immediately.
