       AN  ACT  to amend the executive law, in relation to the inclusion of the
         office for the aging in the disaster preparedness commission
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Subdivision 1 of section 21 of the executive law, as sepa-
    2  rately amended by section 2 of part G and section 7 of part O of chapter
    3  55 of the laws of 2012, is amended to read as follows:
    4    1. There is hereby created in  the  executive  department  a  disaster
    5  preparedness  commission  consisting of the commissioners of transporta-
    6  tion, health, division of criminal justice services, education, economic
    7  development, agriculture and markets,  housing  and  community  renewal,
    8  general  services,  labor,  environmental  conservation,  mental health,
    9  parks, recreation and historic preservation, corrections  and  community
   10  supervision,  children  and family services, homeland security and emer-
   11  gency services, and people with developmental disabilities,  the  presi-
   12  dent  of  the  New York state energy research and development authority,
   13  the superintendents of state police and financial services,  the  secre-
   14  tary  of  state,  the  state fire administrator, the chair of the public
   15  service commission, the adjutant  general,  the  office  of  information
   16  technology  services,  and  the office of victim services, the chairs of
   17  the thruway authority, THE OFFICE FOR THE AGING, the metropolitan trans-
   18  portation authority, the port authority of New York and New Jersey,  the
   19  chief  professional  officer  of  the  state coordinating chapter of the
   20  American Red Cross and three additional members, to be appointed by  the
   21  governor,  two of whom shall be chief executives. Each member agency may
   22  designate an executive level officer of that agency, with responsibility
   23  for disaster preparedness matters, who may represent that agency on  the
   24  commission.  The  commissioner  of the division of homeland security and

    1  emergency services shall serve as  chair  of  the  commission,  and  the
    2  governor  shall  designate the vice chair of the commission. The members
    3  of the commission, except those who serve ex officio, shall  be  allowed
    4  their actual and necessary expenses incurred in the performance of their
    5  duties  under  this article but shall receive no additional compensation
    6  for services rendered pursuant to this article.
