          tee on Energy -- committee discharged, bill amended, ordered reprinted
          as amended and recommitted to said committee

        AN  ACT to amend the public service law, in relation to certification of
          major electric generating facilities

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Section 168 of the public service law is amended by adding
     2  a new subdivision 3-a to read as follows:
     3    3-a. The board shall not grant a certificate for the  construction  or
     4  operation  of a major electric generating facility unless the Department
     5  of Defense's Military Aviation and Installation Assurance Siting  Clear-
     6  inghouse has reviewed the impact of such facility.
     7    § 2. Subdivision 1 of section 164 of the public service law is amended
     8  by adding a new paragraph (n) to read as follows:
     9    (n)  An  evaluation from the Department of Defense's Military Aviation
    10  and Installation Assurance Siting  Clearinghouse  considering  potential
    11  impacts and exploring mitigation options.
    12    § 3. This act shall take effect immediately.
