       AN ACT to amend the public health law, in relation  to  prohibiting  the
         use or sale of food products made with high-fructose corn syrup
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The public health law is amended by adding  a  new  section
    2  1352-d to read as follows:
    3    S 1352-D. HIGH-FRUCTOSE CORN SYRUP; PROHIBITION. NO FOOD ITEM OR PROD-
    4  UCT  CONTAINING HIGH-FRUCTOSE CORN SYRUP SHALL BE SOLD, STORED, DISTRIB-
    5  UTED, HELD FOR SERVICE, OR USED IN PREPARATION OF ANY FOOD PRODUCT TO BE
    6  SERVED OR SOLD IN ANY RESTAURANTS, FOOD SERVICE  ESTABLISHMENTS,  RETAIL
    7  FOOD  STORES  AS  DEFINED IN SECTION FIVE HUNDRED OF THE AGRICULTURE AND
    8  MARKETS LAW, AND OTHER FOOD ESTABLISHMENTS. THE COMMISSIONER IS  AUTHOR-
    9  IZED  AND  DIRECTED  TO  PROMULGATE  RULES  AND REGULATIONS NECESSARY TO
   10  IMPLEMENT THE PROVISIONS OF THIS SECTION.
   11    S 2. This act shall take effect immediately.
