STATE OF NEW YORK ________________________________________________________________________ 2766 2019-2020 Regular Sessions IN ASSEMBLY January 25, 2019 ___________ Introduced by M. of A. HEVESI -- read once and referred to the Committee on Children and Families AN ACT to amend the social services law, in relation to standards and training for child day care The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraphs (viii) and (ix) of paragraph (b) of subdivi- 2 sion 3 of section 390-a of the social services law, subparagraph (viii) 3 as amended by chapter 552 of the laws of 2003 and subparagraph (ix) as 4 amended by chapter 117 of the laws of 2010, are amended and a new 5 subparagraph (x) is added to read as follows: 6 (viii) statutes and regulations pertaining to child abuse and 7 maltreatment; [and] 8 (ix) for operators, program directors, employees and assistants of 9 family day care homes, group family day care homes and child day care 10 centers, education and information on the identification, diagnosis and 11 prevention of shaken baby syndrome[.]; and 12 (x) adverse childhood experiences (ACEs), focused on understanding 13 trauma and on nurturing resiliency. 14 § 2. Subdivision 3 of section 390-a of the social services law is 15 amended by adding a new paragraph (f) to read as follows: 16 (f) The office of children and family services shall issue regulations 17 establishing that training with respect to adverse childhood experiences 18 shall be included within the minimum health and safety training require- 19 ments for child day care providers, including those that are otherwise 20 legally exempt from the provisions of section three hundred ninety of 21 this article, other than the parent, step-parent, guardian, or relative 22 within the third degree of consanguinity of the parents or step-parents 23 of such child who provides care only for a child or children related to 24 them. This act shall take effect on the one hundred eightieth day after 2 it shall have become a law. Effective immediately, the addition, amend- 3 ment and/or repeal of any rule or regulation necessary for the implemen- 4 tation of this act on its effective date are authorized to be made and 5 completed by the commissioner of the office of children and family 6 services on or before such date.
