        AN ACT to amend the general business law, in relation to prohibiting the
          sale of merchandise with symbols of hate

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. The general business law is amended by adding a new section
     2  391-bb to read as follows:
     3    §  391-bb.  Prohibit  sale  of merchandise with symbols of hate. 1. No
     4  person, firm, partnership, association or  corporation  shall  sell  any
     5  merchandise  which displays any symbols of hate or any similar image, or
     6  tangible personal property, inscribed with  such  an  image  unless  the
     7  image  appears in a book, digital medium, museum, or otherwise serves an
     8  educational or historical purpose.
     9    2. For the purposes of this section, the term "symbols of hate"  shall
    10  include,  but  not  be  limited to, symbols of white supremacy, neo-Nazi
    11  ideology or the Battle Flag of the Confederate.
    12    § 2. This act shall take effect immediately.
