       AN ACT to amend the correction law, in relation to requiring the depart-
         ment of correctional services to collect certain data from any persons
         admitted into certain facilities
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 1 of section  29  of  the  correction  law,  as
    2  amended  by  chapter  598  of  the  laws  of 1990, is amended to read as
    3  follows:
    4    1. The department shall continue to  collect,  maintain,  and  analyze
    5  statistical  and  other  information  and  data  with respect to persons
    6  subject to the jurisdiction of the department, including but not limited
    7  to: (a) the number of such persons: placed in the custody of the depart-
    8  ment, assigned to a  specific  department  program,  accorded  temporary
    9  release,  paroled  or  conditionally  released, paroled or conditionally
   10  released and declared delinquent, recommitted to  a  state  correctional
   11  institution  upon  revocation  of  parole  or  conditional  release,  or
   12  discharge upon maximum expiration of sentence; (b) the criminal  history
   13  of  such  persons;  (c)  the social, educational, and vocational circum-
   14  stances of any such persons; [and,] (d) the  institutional,  parole  and
   15  conditional release programs and behavior of such persons; AND (E) PRIOR
   16  INVOLVEMENT  WITH  THE  CHILD  WELFARE AND/OR JUVENILE JUSTICE SYSTEM OF
   17  SUCH PERSONS, INCLUDING BUT NOT LIMITED TO: (I)  PREVIOUS  PLACEMENT  IN
   18  OUT-OF-HOME  CARE,  AND THE TYPE OF PLACEMENT, INCLUDING BUT NOT LIMITED
   19  TO PLACEMENT IN FOSTER  CARE,  KINSHIP  FOSTER  CARE,  SECURE  DETENTION
   20  FACILITIES,  NON-SECURE  DETENTION  FACILITIES,  GROUP  HOMES  OR  OTHER
   21  AUTHORIZED AGENCIES OR FACILITIES OPERATED OR LICENSED BY THE OFFICE  OF
   22  CHILDREN AND FAMILY SERVICES, (II) THE APPROXIMATE LENGTH OF SUCH PERIOD
   23  OF  PLACEMENT,  AND  (III)  THE AGE OF SUCH PERSON DURING SUCH PERIOD OF
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1  PLACEMENT. STATISTICAL INFORMATION COLLECTED PURSUANT TO  PARAGRAPH  (E)
    2  OF  THIS  SUBDIVISION SHALL BE PUBLISHED ON AN ANNUAL BASIS AND SHALL BE
    3  MADE AVAILABLE TO THE PUBLIC.  SUCH  STATISTICAL  INFORMATION  SHALL  BE
    4  PUBLISHED  IN  SUCH  A MANNER AS TO PREVENT THE DISCLOSURE OF PERSONALLY
    5  IDENTIFIABLE INFORMATION.  Provided, however, in the event  any  statis-
    6  tical information on the ethnic background of the inmate population of a
    7  correctional facility or facilities is collected by the department, such
    8  statistical  information  shall  contain,  but  not  be  limited to, the
    9  following ethnic categories: (i) Caucasian; (ii) Asian;  (iii)  American
   10  Indian;  (iv)  Afro-American/Black;  and  (v)  Spanish speaking/Hispanic
   11  which category shall include, but  not  be  limited  to,  the  following
   12  subcategories  consisting of: (1) Puerto Ricans; (2) Cubans; (3) Domini-
   13  cans; and (4) other Hispanic nationalities.
   14    S 2. This act shall take effect on the thirtieth day  after  it  shall
   15  have become a law.
