       AN ACT to amend the state finance law, in relation to the New York State
         emergency services revolving loan account
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (a) of subdivision 4  of  section  97-pp  of  the
    2  state  finance  law, as amended by section 30 of part B of chapter 56 of
    3  the laws of 2010, is amended to read as follows:
    4    (a) The commissioner of the division of homeland security and emergen-
    5  cy services, on recommendation of  the  state  fire  administrator,  may
    6  make,  upon application duly made, up to the amounts available by appro-
    7  priation, loans for:
    8    (i) Purchasing fire fighting apparatus. A  loan  for  purchasing  fire
    9  fighting  apparatus  shall not exceed the lesser of [two hundred twenty-
   10  five thousand] THREE HUNDRED SEVENTY-FIVE THOUSAND dollars  or  seventy-
   11  five  percent  of  the  cost  of  the fire fighting apparatus; provided,
   12  however, that loans issued in response to a joint application shall  not
   13  exceed  the lesser of [four hundred] FIVE HUNDRED FIFTY thousand dollars
   14  or seventy-five percent of the cost of the fire fighting apparatus.
   15    (ii) Purchasing ambulances or rescue vehicles. A loan  for  purchasing
   16  an  ambulance  or  a  rescue vehicle shall not exceed the lesser of [one
   17  hundred fifty] TWO HUNDRED TWENTY-FIVE thousand dollars or  seventy-five
   18  percent of the cost of the ambulance or rescue vehicle; provided, howev-
   19  er,  that  loans  issued  in  response  to a joint application shall not
   20  exceed the lesser of [two hundred sixty-five] THREE HUNDRED FIFTY  thou-
   21  sand  dollars  or  seventy-five  percent of the cost of the ambulance or
   22  rescue vehicle.

    1    (iii) Purchasing protective equipment or  communication  equipment.  A
    2  loan  for  purchasing protective equipment or communication equipment or
    3  both shall not exceed [one hundred] TWO HUNDRED thousand dollars. Commu-
    4  nication equipment purchased with such loan shall, to the maximum extent
    5  practicable,  be compatible with the communication equipment of adjacent
    6  services and jurisdictions; provided,  however,  that  loans  issued  in
    7  response  to  a  joint  application shall not exceed [one hundred sixty-
    8  five] TWO HUNDRED SIXTY-FIVE thousand dollars.
    9    (iv) Repairing or rehabilitating fire fighting apparatus,  ambulances,
   10  or rescue vehicles. A loan for repairing or rehabilitating fire fighting
   11  apparatus, ambulances, or rescue vehicles shall not exceed the lesser of
   12  [seventy-five]  TWO  HUNDRED  thousand dollars or one hundred percent of
   13  the cost of the repair or rehabilitation; provided, however, that  loans
   14  issued in response to a joint application shall not exceed the lesser of
   15  [one  hundred  thirty-five] FOUR HUNDRED thousand dollars or one hundred
   16  percent of the cost of the repair or rehabilitation.
   17    (v) Purchasing accessory equipment. A loan  for  purchasing  accessory
   18  equipment  shall not exceed [seventy-five] ONE HUNDRED TWENTY-FIVE thou-
   19  sand dollars; provided, however, that loans  issued  in  response  to  a
   20  joint application shall not exceed [one hundred thirty-five] ONE HUNDRED
   21  SEVENTY-FIVE thousand dollars.
   22    (vi)  Renovating,  rehabilitating  or  repairing facilities that house
   23  firefighting equipment, ambulances, rescue vehicles and  related  equip-
   24  ment.  A  loan  for  this  purpose  shall  not exceed the lesser of [one
   25  hundred fifty]  TWO  HUNDRED  FIFTY  thousand  dollars  or  seventy-five
   26  percent of the cost of the project; provided, however, that loans issued
   27  in  response  to a joint application shall not exceed the lesser of [two
   28  hundred  sixty-five]  FIVE  HUNDRED  thousand  dollars  or  seventy-five
   29  percent of the cost of the project.
   30    (vii)  Construction costs associated with the establishment of facili-
   31  ties that house firefighting equipment, ambulances, rescue vehicles  and
   32  related  equipment.  A loan for this purpose shall not exceed the lesser
   33  of [three hundred] FIVE HUNDRED thousand dollars or seventy-five percent
   34  of the cost of the construction, or be used for the payment of fees  for
   35  design, planning, preparation of applications or other costs not direct-
   36  ly attributable to land acquisitions or construction; provided, however,
   37  that  loans  issued  in response to a joint application shall not exceed
   38  the lesser of [five hundred twenty-five] SEVEN  HUNDRED  FIFTY  thousand
   39  dollars  or  seventy-five percent of the cost of the construction, or be
   40  used for the payment of fees for design, planning, preparation of appli-
   41  cations or other costs not directly attributable to land acquisitions or
   42  construction.
   43    (viii) Construction costs associated with the establishment of facili-
   44  ties for the purpose of live fire training.  A  loan  for  this  purpose
   45  shall  not  be granted if another live fire training facility is located
   46  within the boundaries of the county or within twenty-five miles.  A loan
   47  for this purpose shall not exceed the lesser of [one hundred fifty]  TWO
   48  HUNDRED  FIFTY  thousand  dollars or seventy-five percent of the cost of
   49  construction, provided, however, joint applications shall not exceed the
   50  lesser of [two hundred sixty-five]  FOUR  HUNDRED  thousand  dollars  or
   51  seventy-five  percent  of  the  cost  of construction or be used for the
   52  payment of fees for design, planning,  preparation  of  applications  or
   53  other   costs   not   directly  attributable  to  land  acquisitions  or
   54  construction.

    1    S 2. Subparagraph (ii) of paragraph (c) of subdivision  5  of  section
    2  97-pp  of  the  state finance law, as amended by section 30 of part B of
    3  chapter 56 of the laws of 2010, is amended to read as follows:
    4    (ii)  In  making determinations on loan applications, the commissioner
    5  of the division of homeland security and emergency services shall assure
    6  that loan fund moneys are equitably distributed among all sectors of the
    7  emergency services community and all geographical areas  of  the  state.
    8  Loans  for  the  purpose  of  personal protective firefighting equipment
    9  shall be given preference for a period of two years from  the  date  the
   10  first  loan  is  made. Not less than fifty percent of the loans annually
   11  made shall be made to applicants  whose  fire  protection  or  ambulance
   12  service  is  provided  by  a  fire department or ambulance service whose
   13  membership is comprised exclusively of volunteers [and whose budget  for
   14  the  fiscal  year immediately preceding did not exceed one hundred thou-
   15  sand dollars].
   16    S 3. This act shall take effect immediately.
