       AN ACT to amend the town law, in relation to building permits issued  in
         Richmond county
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The town law is amended by adding a new  section  261-d  to
    2  read as follows:
    3    S  261-D.  BUILDING  PERMIT  PROCESS  IN  RICHMOND COUNTY. NO BUILDING
    4  PERMIT FOR RESIDENTIAL CONSTRUCTION OF A NEW HOME SHALL BE ISSUED BY ANY
    5  TOWN LOCATED WITHIN RICHMOND COUNTY  UNTIL  THE  DISTRICT  SCHOOL  BOARD
    6  CERTIFIES TO THE BUILDING DEPARTMENT OR OTHER ENTITY AUTHORIZED TO ISSUE
    7  BUILDING  PERMITS  THAT  THERE  ARE  TWO  SEATS AVAILABLE IN SUCH SCHOOL
    8  DISTRICT WITHIN THE BOUNDARIES OF THE NEIGHBORHOOD SCHOOL WHERE CHILDREN
    9  LIVING IN ANY SUCH HOME WOULD BE ASSIGNED TO ATTEND.
   10    S 2. This act shall take effect immediately and shall apply to  appli-
   11  cations submitted on and after such date.
