       AN  ACT  to  amend  the  environmental  conservation law, in relation to
         requiring the department of environmental conservation to  notify  the
         community  boards of New York city of any new brownfield site cleanups
         within such community board's boundaries
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  3  of  section  27-1405 of the environmental
    2  conservation law, as added by section 1 of part A of chapter  1  of  the
    3  laws of 2003, is amended to read as follows:
    4    3.  "Brownfield  site  contact  list"  shall  mean  a list of persons,
    5  government agencies, groups, or organizations, including, but not limit-
    6  ed to the chief executive officer and zoning board of each county, city,
    7  town and village in which such site is located, IN A CITY WITH  A  POPU-
    8  LATION OF ONE MILLION OR MORE, ANY COMMUNITY BOARD IN WHICH SUCH SITE IS
    9  LOCATED,  the  public water supplier which serves the area in which such
   10  site is located, any site residents, any person who has requested to  be
   11  placed  on the site contact list, and the administrator of any school or
   12  day care facility located on the site for the purposes of posting and/or
   13  dissemination at the facility. For the purposes of this  section  "water
   14  supplier"  means any public water system as such term is defined for the
   15  purposes of the sanitary code of the state of New York as authorized  by
   16  section  two  hundred  twenty-five  of  the public health law. Provided,
   17  however, that where the site or adjacent real property contains multiple
   18  dwelling units, the applicant shall work with the department to  develop

    1  an  alternative  method  for providing such notice in lieu of mailing to
    2  each individual.
    3    S 2. This act shall take effect on the one hundred twentieth day after
    4  it shall have become a law; provided, however, that effective immediate-
    5  ly,  the  addition,  amendment  and/or  repeal of any rule or regulation
    6  necessary for the implementation of this act on its effective  date  are
    7  authorized  and  directed  to  be  made  and completed on or before such
    8  effective date.
