       AN ACT to amend the  education  law,  in  relation  to  enabling  public
         libraries  to  access  employment preparation education (EPE) funds to
         provide adult literacy instruction
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  11  of  section 3602 of the education law is
    2  amended by adding a new paragraph a-2 to read as follows:
    3    A-2. NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH A  OF  THIS  SUBDIVI-
    4  SION,  THE  COMMISSIONER  SHALL  SET  ASIDE  AN  AMOUNT OF THREE MILLION
    5  DOLLARS OR THE UNSPENT REMAINDER OF THE PREVIOUS SCHOOL YEAR'S APPROPRI-
    6  ATION FOR THIS PROGRAM, WHICHEVER IS  MORE,  TO  BE  AWARDED  THROUGH  A
    7  COMPETITIVE  GRANT  PROCESS  TO  PUBLIC  LIBRARIES TO PROVIDE ANY OF THE
    8  SERVICES AUTHORIZED IN THIS SUBDIVISION. HOWEVER, NO LESS THAN HALF  THE
    9  ANNUAL  APPROPRIATION  SHALL BE SET ASIDE FOR PUBLIC LIBRARIES SERVING A
   10  POPULATION OF ONE MILLION OR  MORE.  THE  COMMISSIONER  SHALL  HAVE  THE
   11  AUTHORITY TO ESTABLISH RULES AND REGULATIONS TO IMPLEMENT THE PROVISIONS
   12  OF THIS PARAGRAPH.
   13    S  2.  This  act  shall  take  effect  on  the first of September next
   14  succeeding the date on which it shall have become a law.
