AN ACT to amend the tax law, in relation to the authority of the direc-
tor of the division of the lottery
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Section 1603 of the tax law is amended by adding a new
2 subdivision 6 to read as follows:
3 6. THE DIRECTOR SHALL HAVE THE AUTHORITY TO ISSUE A LICENSE FOR ANY
4 ON-LINE LOTTERY GAME WHETHER KNOWN AS "QUICK DRAW" OR BY ANY OTHER NAME
5 TO ANY BUSINESS WHICH HAD BEEN PREVIOUSLY DENIED SUCH LICENSE BECAUSE IT
6 DID NOT MEET THE SPACE REQUIREMENTS OF THE DIVISION. THE DIRECTOR SHALL
7 HAVE THE AUTHORITY TO REVOKE SUCH LICENSE IF THE SALES OF SUCH ON-LINE
8 LOTTERY GAMES BY ANY BUSINESS ARE INSUFFICIENT TO MEET ADMINISTRATIVE
9 COSTS AND PUBLIC CONVENIENCE IS ADEQUATELY SERVED BY OTHER LICENSEES.
10 S 2. This act shall take effect immediately.
