       AN ACT to amend the military law, in relation to    expanding  the  paid
         leave for public officers and public employee reservists
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 5 of  section  242  of  the  military  law,  as
    2  amended  by  chapter  161  of  the  laws  of 1984, is amended to read as
    3  follows:
    4    5.  Pay for military duty. (A) Every public officer or employee  shall
    5  be  paid  his  salary  or  other  compensation as such public officer or
    6  employee for any and  all  periods  of  absence  while  engaged  in  the
    7  performance  of  ordered military duty, and while going to and returning
    8  from such duty, not exceeding a total of  [thirty]  FORTY-NINE  days  or
    9  [twenty-two]  THIRTY  working  days,  whichever  is  greater, in any one
   10  calendar year and not exceeding [thirty] FORTY-NINE days or [twenty-two]
   11  THIRTY working days, whichever is greater, in any one continuous  period
   12  of such absence.
   13    (B)  ALL  COUNTY AND MUNICIPAL EMPLOYEES WHO ARE MEMBERS OF THE ORGAN-
   14  IZED RESERVE OF THE UNITED STATES ARMED FORCES, INCLUDING  THE  NATIONAL
   15  GUARD  OF  THIS  STATE,  SHALL  BE  ALLOWED FULL PAY FOR ALL TIME NOT IN
   16  EXCESS OF FORTY-NINE DAYS PER YEAR SPENT  ON  DUTY  IN  CONNECTION  WITH
   17  RESERVE TRAINING AND INSTRUCTION REQUIREMENTS OF THE ARMED FORCES OF THE
   18  UNITED  STATES,  INCLUDING  THE NATIONAL GUARD OF THIS STATE. THIS LEAVE
   19  SHALL BE AT THE DISCRETION OF THE EMPLOYING COUNTY OR  MUNICIPALITY  AND
   20  SHALL  BE  IN ADDITION TO ANY ANNUAL VACATION LEAVE WITH PAY TO WHICH AN
   21  EMPLOYEE MAY BE ENTITLED.
   22    S 2. This act shall take effect immediately.
