RIVERA, TOWNS, WEISENBERG -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to aggravated harassment of an individual through electronic mail THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 240.30 of the penal law is amended by adding a new 2 subdivision 1-a to read as follows: 3 1-A. TRANSMITS AN ELECTRONIC MESSAGE OVER A COMPUTER NETWORK WITHOUT 4 THE EXPRESS AUTHORITY OF THE RECIPIENT, WHEN SUCH MESSAGE PROVIDES 5 NEITHER ANY PURPOSE OF LEGITIMATE COMMUNICATION NOR ANY INFORMATION TO 6 THE RECIPIENT WHICH WOULD ALLOW A DIRECT REPLY TO INFORM THE SENDER OF 7 THE ANNOYANCE; OR 8 S 2. This act shall take effect on the first of November next succeed- 9 ing the date on which it shall have become a law.
