       AN  ACT  to amend the penal law, in relation to aggravated harassment of
         an individual through electronic mail
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Section 240.30 of the penal law is amended by adding a new
    2  subdivision 1-a to read as follows:
    3    1-A. TRANSMITS AN ELECTRONIC MESSAGE OVER A COMPUTER  NETWORK  WITHOUT
    4  THE  EXPRESS  AUTHORITY  OF  THE  RECIPIENT,  WHEN SUCH MESSAGE PROVIDES
    5  NEITHER ANY PURPOSE OF LEGITIMATE COMMUNICATION NOR ANY  INFORMATION  TO
    6  THE  RECIPIENT  WHICH WOULD ALLOW A DIRECT REPLY TO INFORM THE SENDER OF
    7  THE ANNOYANCE; OR
    8    S 2. This act shall take effect on the first of November next succeed-
    9  ing the date on which it shall have become a law.
