       AN ACT to amend the county law, in  relation  to  establishing  a  pilot
         program  in  Nassau  and  Suffolk  counties  for  the  transmission of
         pictures and videos by emergency callers; to amend the  state  finance
         law,  in  relation  to  establishing  a  911 emergency transmission of
         picture and video pilot program  fund;  and  making  an  appropriation
         therefor
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The county law is amended by adding a new  section  334  to
    2  read as follows:
    3    S 334. TRANSMISSIONS OF PICTURE AND VIDEO; PILOT PROGRAM. 1. THE BOARD
    4  SHALL  ESTABLISH A PILOT PROGRAM FOR THE COUNTIES OF NASSAU AND SUFFOLK,
    5  WHEREBY CALLERS MAY SEND PICTURES  OR  VIDEOS  TO  LOCAL  PUBLIC  SAFETY
    6  ANSWERING  POINTS OR STATE PUBLIC SAFETY ANSWERING POINTS. THE ANSWERING
    7  POINT SHALL SEND A PRE-FORMATTED TEXT MESSAGE  TO  A  CALLER'S  WIRELESS
    8  COMMUNICATIONS  DEVICE.  THE  CALLER  MAY  REPLY  TO THE TEXT MESSAGE BY
    9  ATTACHING THE PHOTO OR VIDEO. THE OPERATOR SHALL THEN FORWARD THE  PHOTO
   10  AND/OR VIDEO TO EMERGENCY RESPONDERS.
   11    2.  ANY  PHOTOS  OR  VIDEOS  SENT TO THE LOCAL PUBLIC SAFETY ANSWERING
   12  POINTS OR STATE PUBLIC SAFETY ANSWERING POINTS  SHALL  AUTOMATICALLY  BE
   13  STORED  IN  AN  INCIDENT  RECORD ALONG WITH ANY DETAILS OF THE EMERGENCY
   14  CALL.
   15    S 2. Section 331 of the county law is amended by adding a new subdivi-
   16  sion 6 to read as follows:
   17    6. EACH LOCAL AND STATE PUBLIC SAFETY ANSWERING POINT INVOLVED IN  THE
   18  PILOT  PROGRAM ESTABLISHED PURSUANT TO SECTION THREE HUNDRED THIRTY-FOUR
   19  OF THIS ARTICLE, SHALL BE ELIGIBLE FOR TEN THOUSAND DOLLARS PER PHONE OR
   20  SO MUCH THEREOF AS MAY BE AVAILABLE IN THE 911 EMERGENCY TRANSMISSION OF
   21  PICTURE AND VIDEO PILOT PROGRAM FUND ESTABLISHED BY SECTION  NINETY-SEV-
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1  EN-JJJJ  OF THE STATE FINANCE LAW, FOR THE IMPLEMENTATION OF PICTURE AND
    2  VIDEO TRANSMISSIONS.
    3    S  3. The state finance law is amended by adding a new section 97-jjjj
    4  to read as follows:
    5    S 97-JJJJ. 911 EMERGENCY  TRANSMISSION  OF  PICTURE  AND  VIDEO  PILOT
    6  PROGRAM FUND. 1. THERE IS HEREBY ESTABLISHED IN THE JOINT CUSTODY OF THE
    7  STATE COMPTROLLER AND THE CHAIRPERSON OF THE BOARD, A SPECIAL FUND TO BE
    8  KNOWN  AS  THE  "911  EMERGENCY  TRANSMISSION OF PICTURE AND VIDEO PILOT
    9  PROGRAM FUND".
   10    2. SUCH FUND SHALL CONSIST OF ALL MONEYS CREDITED OR APPROPRIATED  FOR
   11  TRANSFER THERETO FROM ANY SOURCE ACCORDING TO LAW.
   12    3. MONEYS OF THE FUND SHALL BE AVAILABLE ONLY FOR THE PAYMENT OF COSTS
   13  ASSOCIATED WITH THE IMPLEMENTATION, MANAGEMENT AND ADMINISTRATION OF THE
   14  TRANSMISSION  OF PICTURE AND VIDEO PILOT PROGRAM ESTABLISHED PURSUANT TO
   15  SECTION THREE HUNDRED THIRTY-FOUR OF THE COUNTY LAW.
   16    4. MONEYS OF THE FUND SHALL BE KEPT SEPARATE AND SHALL NOT BE  COMMIN-
   17  GLED  WITH  ANY OTHER MONEYS IN THE CUSTODY OF THE COMPTROLLER. ANY SUCH
   18  MONEYS IN THE FUND  MAY,  IN  THE  DISCRETION  OF  THE  COMPTROLLER,  BE
   19  INVESTED IN OBLIGATIONS IN WHICH THE COMPTROLLER IS AUTHORIZED TO INVEST
   20  PURSUANT TO SECTION NINETY-EIGHT-A OF THIS ARTICLE. ANY INCOME OR INTER-
   21  EST FROM SUCH INVESTMENT SHALL BE CREDITED TO SUCH FUND.
   22    5. ALL PAYMENTS OF MONEYS FROM THE FUND SHALL BE MADE ON THE AUDIT AND
   23  WARRANT OF THE COMPTROLLER.
   24    S  4.  The sum of one million dollars ($1,000,000), or so much thereof
   25  as shall be necessary to accomplish the purposes of this act  is  hereby
   26  appropriated  from  any moneys in the state treasury in the general fund
   27  to the credit of the 911 emergency transmission  of  picture  and  video
   28  pilot  program  fund  not  otherwise  appropriated  and made immediately
   29  available to the New York state 911 board for its expenses.  The  moneys
   30  appropriated  herein  when  made  available pursuant to a certificate of
   31  availability issued by the director of the budget shall be paid  out  of
   32  the  state  treasury  on  audit  and warrant of the state comptroller on
   33  vouchers approved by the chairperson of the New York state 911 board.
   34    S 5. This act shall take effect on January 1,  2010.  Effective  imme-
   35  diately,  the  New York state 911 board shall promulgate rules and regu-
   36  lations necessary for the implementation of this act on  or  before  its
   37  effective date.
