STATE OF NEW YORK ________________________________________________________________________ 7559--A 2019-2020 Regular Sessions IN ASSEMBLY May 9, 2019 ___________ Introduced by M. of A. FAHY -- read once and referred to the Committee on Education -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the education law, in relation to directing a study on the feasibility of adjusting the compulsory attendance age of minors attending full time instruction The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 305 of the education law is amended by adding a new 2 subdivision 60 to read as follows: 3 60. On or before July first, two thousand twenty-one, the commissioner 4 shall conduct a study on the feasibility of adjusting the compulsory 5 attendance age for when minors shall attend full time instruction and 6 deliver a report of the findings and recommendations based on such find- 7 ings to the governor, the temporary president of the senate, and the 8 speaker of the assembly. The commissioner shall consult with educators, 9 parents, and other stakeholders to conduct a study which shall include, 10 but not be limited to: 11 (a) the social, emotional, and educational appropriateness of the 12 state's compulsory attendance age for when minors shall attend full time 13 instruction; 14 (b) the appropriateness and feasibility of adjusting the age of 15 required attendance to start school in New York state to minors who 16 become five years of age after the first of September in any school 17 year; and 18 (c) the educational programs and services available to minors who 19 would otherwise be enrolled in prekindergarten pursuant to an adjustment 20 in the state's compulsory attendance age. 21 § 2.
