       AN ACT to amend the public health  law,  in  relation  to  permitting  a
         hospice  to  employ  and enter into contracts with licensed healthcare
         providers
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Section 4002 of the public health law is amended by adding
    2  a new subdivision 5 to read as follows:
    3    5. "TERMINALLY ILL" MEANS AN INDIVIDUAL HAS A MEDICAL  PROGNOSIS  THAT
    4  THE  INDIVIDUAL'S  LIFE  EXPECTANCY IS APPROXIMATELY ONE YEAR OR LESS IF
    5  THE ILLNESS RUNS ITS NORMAL COURSE.
    6    S 2. Subdivision 3 of section 4008 of the public health law, as  added
    7  by chapter 416 of the laws of 1983, is amended to read as follows:
    8    3. Subject to the provisions of this section and section four thousand
    9  ten  of this article, contractual agreements between a hospice and other
   10  providers of other care and services shall  not  be  prohibited,  AND  A
   11  HOSPICE  MAY EMPLOY AND ENTER INTO CONTRACTS WITH ANY LAWFUL COMBINATION
   12  OF LICENSED HEALTHCARE PROFESSIONALS IN RELATION TO SERVICES PROVIDED BY
   13  THE HOSPICE UNDER THIS ARTICLE, provided that the hospice maintains full
   14  responsibility for  the  planning,  coordination  and  quality  of  such
   15  services  and  the  adherence  to  the  plan of care established for the
   16  patients.
   17    S 3. This act shall take effect immediately.
