        AN ACT to amend the education  law,  in  relation  to  requirements  for
          licensure as a dentist

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivisions 3 and 6 of section 6604 of the education  law,
     2  subdivision 3 as amended by chapter 613 of the laws of 2022 and subdivi-
     3  sion  6  as  amended  by chapter 669 of the laws of 2022, are amended to
     4  read as follows:
     5    (3) Experience: (a) have experience satisfactory to the board  and  in
     6  accordance with the commissioner's regulations, provided that such expe-
     7  rience shall consist of satisfactory completion of a postdoctoral gener-
     8  al  practice  or  specialty  dental  residency  program, of at least one
     9  year's duration, in a hospital or dental facility accredited for  teach-
    10  ing  purposes by a national accrediting body approved by the department,
    11  provided, further that any such residency program shall include a formal
    12  outcome assessment evaluation of the resident's competence  to  practice
    13  dentistry acceptable to the department; or
    14    (b) notwithstanding paragraph (a) of this subdivision, have experience
    15  satisfactory  to  the  board  and  in accordance with the commissioner's
    16  regulations, provided that where an applicant has completed a program of
    17  dental education in a foreign dental school recognized by the  appropri-
    18  ate  civil  authorities of the country in which the school is located as
    19  acceptable for entry into practice in such country, such experience  may
    20  consist of a minimum of three years of full-time dental practice, or the
    21  equivalent thereof, in the country of such unregistered and unaccredited
    22  foreign  dental  school  within the five years immediately preceding the
    23  submission of an initial license  application,  and  the  completion  of
    24  either (i) at least one year of experience as a full-time faculty member

     1  employed  at  an approved New York state school of dentistry, or (ii) at
     2  least  one year of full-time experience, or the equivalent thereof, as a
     3  general practice dental intern in an internship program under the super-
     4  vision of a licensed dentist in  an area  which  has  been designated  a
     5  federal  dental  health professions shortage area, provided further that
     6  the  licensed  dentist who supervises such an intern shall be designated
     7  the preceptor dentist, have practiced for at least five years immediate-
     8  ly preceding assuming a preceptorship, and have under his or her  super-
     9  vision  not  more  than one full-time intern nor more than two part-time
    10  interns;
    11    (6) Citizenship or immigration status: be a United States citizen or a
    12  noncitizen lawfully admitted  for  permanent  residence  in  the  United
    13  States;  provided,  however, that the board of regents may grant a three
    14  year waiver for a noncitizen to practice  in  an  area  which  has  been
    15  designated  a  federal  dental  health professions shortage area, except
    16  that the board of regents may  grant  an  additional  extension  not  to
    17  exceed six years to a noncitizen to enable him or her to secure citizen-
    18  ship or permanent resident status, provided such status is being active-
    19  ly  pursued; and provided further that the board of regents may grant an
    20  additional three-year waiver, and at its expiration, an extension for  a
    21  period  not  to  exceed  six additional years, for the holder of an H-1b
    22  visa, an O-1 visa, or an equivalent or successor visa thereto;
    23    § 2. This act shall take effect immediately.
