        AN  ACT  to amend the executive law, in relation to requiring de-escala-
          tion training for police officers

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Section 840 of the executive law is amended by adding a new
     2  subdivision 7 to read as follows:
     3    7. The council shall, in addition:
     4    (a)  Develop, maintain and disseminate written policies and procedures
     5  regarding interactions that may require  de-escalation  techniques.  For
     6  the  purposes of this subdivision, "de-escalation techniques" shall mean
     7  the use of non-violent strategies and techniques to decrease the  inten-
     8  sity  of  a  situation,  improve decision-making, improve communication,
     9  reduce the need for force and increase voluntary compliance. Such  poli-
    10  cies and procedures shall make provisions for the education and training
    11  of new and veteran police officers on the recognition of and response to
    12  interactions  where de-escalation techniques are required and the appro-
    13  priate de-escalation techniques to use in such interaction; and
    14    (b) Recommend to the governor, rules and regulations with  respect  to
    15  the  establishment  and implementation on an ongoing basis of a training
    16  program for all current and new police officers regarding  the  policies
    17  and  procedures  established  pursuant  to  this subdivision, along with
    18  recommendations for periodic retraining of police officers.
    19    § 2. This act shall take effect on the sixtieth  day  after  it  shall
    20  have become a law. Effective immediately, the addition, amendment and/or
    21  repeal  of  any  rule  or regulation necessary for the implementation of
    22  this act on its effective date are authorized to be made  on  or  before
    23  such date.
