STATE OF NEW YORK ________________________________________________________________________ 9682 IN ASSEMBLY March 28, 2022 ___________ Introduced by M. of A. ABBATE -- read once and referred to the Committee on Governmental Employees AN ACT to amend the retirement and social security law, in relation to waiving approval and income limitations on retirees employed in public schools; and providing for the repeal of such provisions upon expira- tion thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 211 of the retirement and social security law is 2 amended by adding a new subdivision 9 to read as follows: 3 9. Notwithstanding the provisions of this section, section two hundred 4 twelve of this article and section four hundred one of this chapter, 5 section five hundred three of the education law and any other law, regu- 6 lation, rule, local law, or charter to the contrary, a retired person 7 may be employed and earn compensation in a position or positions in a 8 school district, a board of cooperative educational services or a county 9 vocational education and extension board in the state without any effect 10 on his or her status as retired and without suspension or diminution of 11 his or her retirement allowance and without prior approval pursuant to 12 subdivision two of this section. Earnings received as a result of 13 employment in a school district, a board of cooperative educational 14 services or a county vocational education and extension board in the 15 state shall not be applied to a retired person's earnings when calculat- 16 ing the earnings limitations imposed by subdivisions one and two of 17 section two hundred twelve of this article. 18 § 2. This act shall take effect immediately and shall expire and be 19 deemed repealed June 30, 2024. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
