       AN  ACT  to amend the tax law, in relation to the distribution of monies
         collected from the public safety communications surcharge
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraphs (d) and (e) of subdivision 6 of section 186-f of
    2  the  tax  law, as added by section 3 of part B of chapter 56 of the laws
    3  of 2009, are amended and a  new  paragraph  (f)  is  added  to  read  as
    4  follows:
    5    (d)  Not  less  than  the  sum of ten million dollars annually must be
    6  disbursed pursuant to article six-A of the county law  and  appropriated
    7  by the legislature; [and]
    8    (e) To provide the costs of debt service for bonds and notes issued to
    9  finance  expedited  deployment  funding  pursuant  to  the provisions of
   10  section three hundred thirty-three of the county law and section sixteen
   11  hundred eighty-nine-h of the public authorities law[.]; AND
   12    (F) UP TO THE SUM OF TWENTY-FIVE MILLION DOLLARS SHALL BE AVAILABLE IN
   13  STATE FISCAL YEAR TWO THOUSAND TEN - TWO THOUSAND ELEVEN AND EACH FISCAL
   14  YEAR THEREAFTER, TO FUND A COMPETITIVE GRANT PROGRAM TO BE  ADMINISTERED
   15  BY  THE  OFFICE  FOR  TECHNOLOGY, WITH GRANTS AWARDED TO ELIGIBLE COUNTY
   16  GOVERNMENTS FOR ASSISTANCE WITH COSTS ASSOCIATED  WITH  THE  MAINTENANCE
   17  AND/OR  IMPROVEMENT OF EMERGENCY COMMUNICATIONS SYSTEMS, WITH PREFERENCE
   18  GOING TO THOSE COUNTIES WHO PROPOSE  SYSTEMS  ENHANCEMENTS  DESIGNED  TO
   19  ACHIEVE REGIONAL OR STATEWIDE INTEROPERABILITY. THE OFFICE FOR TECHNOLO-
   20  GY  SHALL  ESTABLISH  BY  RULE OR REGULATION THE SPECIFIC CRITERIA TO BE
   21  USED IN JUDGING FROM AMONG THOSE PROPOSALS  SUBMITTED  EACH  YEAR  THOSE
   22  WHICH DESERVE FUNDING.
   23    S 2. This act shall take effect immediately.
