        AN ACT to amend the vehicle and traffic law, in relation to  authorizing
          a residential parking system in the village of South Nyack

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
     2  section 1640-q to read as follows:
     3    § 1640-q. Residential parking system in the village of South Nyack. 1.
     4  Notwithstanding  the provisions of any law to the contrary, the board of
     5  trustees of the village of South Nyack may, by adoption of a  local  law
     6  or  ordinance,  provide  for a residential parking permit system and fix
     7  and require the payment of fees applicable to parking within the area in
     8  which such parking system is in effect in accordance with the provisions
     9  of this section.
    10    2. Such residential parking permit  system  may  only  be  established
    11  within  the village of South Nyack with the area of the village consist-
    12  ing of the following roadways:
    13    (a) Cedar Hill Avenue;
    14    (b) Division Avenue;
    15    (c) Voorhis Avenue;
    16    (d) Depot Place;
    17    (e) Maple Street;
    18    (f) Washington Street;
    19    (g) Prospect Street;
    20    (h) Elysian Avenue;
    21    (i) White Avenue;
    22    (j) Brookside Avenue;
    23    (k) Clinton Avenue;
    24    (l) Gesner Avenue;
    25    (m) South Broadway;
    26    (n) Washington Avenue;
    27    (o) Mansfield Avenue;
    28    (p) Piermont Avenue;

     1    (q) Comelison Avenue;
     2    (r) South Franklin Street;
     3    (s) Ross Avenue;
     4    (t) Spring Street;
     5    (u) Cooper Drive;
     6    (v) Prall Place;
     7    (w) Smith Avenue;
     8    (x) Glen Byron Avenue;
     9    (y) Edgewater Lane;
    10    (z) Gumee Avenue;
    11    (aa) Salisbury Place;
    12    (bb) Elizabeth Place;
    13    (cc) Hamilton Place; and
    14    (dd) Livingston Place.
    15    3. Notwithstanding the foregoing, no permit shall be required on those
    16  portions  of  such  streets  where the adjacent properties are zoned for
    17  commercial, office and/or retail use.
    18    4. The local law or ordinance providing for such  residential  parking
    19  system shall:
    20    (a)  set  forth  factors  necessitating  the enactment of such parking
    21  system; and
    22    (b) provide that motor vehicles registered pursuant  to  section  four
    23  hundred  four-a of this chapter shall be exempt from any permit require-
    24  ment; and
    25    (c) provide the times of the day and days of  the  week  during  which
    26  permit requirements shall be in effect; and
    27    (d)  make not less than twenty percent of all spaces within the permit
    28  area available to non-residents, and shall provide for short-term  park-
    29  ing of not less than ninety minutes in duration in such area; and
    30    (e) provide the schedule of fees to be paid for such permits; and
    31    (f)  provide  that  such fees shall be credited to the general fund of
    32  the city unless otherwise specified in such local law or ordinance.
    33    5. No ordinance shall be adopted pursuant  to  this  section  until  a
    34  public  hearing  thereon has been had in the same manner as required for
    35  public hearings on a local law pursuant to the municipal home rule law.
    36    § 2. This act shall take effect immediately.
