        AN ACT to amend the  navigation  law,  in  relation  to  the  authorized
          reimbursement  rate paid to governmental entities for local navigation
          enforcement expenditures
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Subdivision  3  of section 79-b of the navigation law, as
     2  amended by section 1 of part D of chapter 109 of the laws  of  2010,  is
     3  amended to read as follows:
     4    3.  The  amount  of state aid to be allocated to eligible governmental
     5  entities pursuant to this article shall be determined by the commission-
     6  er  as  hereinafter  provided.  The  commissioner  shall  determine  the
     7  percentage proportion which the authorized expenditures of each individ-
     8  ual  entity, not exceeding four hundred thousand dollars for each county
     9  including municipalities therein, shall bear  to  the  total  authorized
    10  expenditures  of  all entities. Such percentage proportion shall then be
    11  applied against an amount equal to one-half of the total of  the  amount
    12  received by the state in each preceding program year in vessel registra-
    13  tion  fees  as  provided  in section twenty-two hundred fifty-one of the
    14  vehicle and traffic law, less no more than thirty  percent,  subject  to
    15  appropriation, which may be used by the commissioner and the commission-
    16  er  of motor vehicles for administrative costs of the program, including

     1  training and equipment, and by the department of environmental conserva-
     2  tion, the division of state police and other state agencies, subject  to
     3  the approval of the commissioner, for the purposes of this article, plus
     4  the  entire  amount  received  pursuant  to  subdivision nine of section
     5  forty-four of this chapter. The amount thus determined shall  constitute
     6  the maximum amount of state aid to which each such entity shall be enti-
     7  tled;  provided, however, that [no entity shall receive] state aid shall
     8  be provided in an amount [in excess] of [fifty] seventy-five percent  of
     9  its  authorized  expenditures  as  approved by the commissioner for such
    10  program year. The commissioner shall  certify  to  the  comptroller  the
    11  amount  thus  determined  for each eligible local governmental entity as
    12  the amount of state aid to be apportioned to such eligible local govern-
    13  mental entity.   The allocation of state aid  to  any  county,  town  or
    14  village  within the Lake George park shall not be reduced because of the
    15  allocation of state aid to the  Lake  George  park  commission.  Of  the
    16  remaining funds received by the state for the registration of vessels as
    17  provided  in  section  twenty-two  hundred  fifty-one of the vehicle and
    18  traffic law, no less than six percent shall be  made  available  to  the
    19  commissioner  for the expenses of the office in providing navigation law
    20  enforcement training and administering the provisions of this section.
    21    § 2. This act shall take effect immediately and  shall  be  deemed  to
    22  have been in full force and effect on and after April 1, 2018.
