        AN  ACT  to  amend the public health law, in relation to deeming central
          venous lines as medically necessary
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Section  2994-ll  of  the public health law is amended by
     2  adding a  new subdivision 4 to read as follows:
     3    4. Discharge of any patients who have  a  condition  that  requires  a
     4  central venous line. As part of discharge planning for patients who will
     5  be discharged from a hospital with a central venous line, the identified
     6  caregiver  shall  be  consulted  as soon as possible, but not later than
     7  twenty-four hours prior to discharge, regarding his or her  capabilities
     8  and  limitations  in  administering  medications  and  providing  proper
     9  central venous line care. In the event that the identified caregiver  is
    10  unwilling  or  unable  to  confidently  carry out his or her duties with
    11  regard to the central venous line, and after such caregiver  is  advised
    12  as  to  all  available  options  for  central venous line care, then the
    13  attending physician shall deem it medically necessary for the patient to
    14  have trained and appropriate medical personnel upon discharge to provide
    15  proper care for the entirety of the administration of the central venous
    16  line.
    17    § 2. This act shall take effect immediately; provided,  however,  that
    18  effective immediately, the addition, amendment and/or repeal of any rule
    19  or regulation necessary for the implementation of this act on its effec-
    20  tive  date  are  authorized  and directed to be made and completed on or
    21  before such effective date.
