        AN ACT to amend the vehicle and traffic law, in relation  to  increasing
          the fines for dumping snow or plowing onto handicapped parking places

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 1203-e of the vehicle and traffic law,  as  amended
     2  by chapter 65 of the laws of 1996, is amended to read as follows:
     3    § 1203-e. Dumping  or plowing snow onto parking places for handicapped
     4  prohibited. [Any] 1. Except as otherwise provided in subdivision two  of
     5  this  section,  any  person  who  knowingly dumps or shovels snow onto a
     6  parking place for handicapped persons rendering such place unusable  for
     7  parking  purposes  shall be subject to a fine of twenty-five dollars for
     8  the first offense and a fine not to exceed one hundred dollars for every
     9  offense thereafter. However, a local or  municipal  government  may,  by
    10  local law or ordinance, establish fines higher than those established in
    11  this  [section]  subdivision,  but in no instance shall the fines exceed
    12  fifty dollars for the first offense  or  two  hundred  dollars  for  the
    13  second or subsequent offense.
    14    2.  Notwithstanding the provisions of subdivision one of this section,
    15  any firm, corporation, partnership or association engaged in the conduct
    16  of any business, trade or commerce or in the furnishing of  any  service

     1  in  this state who knowingly dumps, shovels or plows snow onto a parking
     2  place for handicapped persons rendering such place unusable for  parking
     3  purposes  shall  be subject to a fine of one hundred twenty-five dollars
     4  for the first offense and a fine not to exceed two hundred fifty dollars
     5  for  every  offense thereafter. However, a local or municipal government
     6  may, by local law or ordinance, establish fines higher than those estab-
     7  lished in this subdivision, but in no instance shall  the  fines  exceed
     8  two  hundred  fifty  dollars for the first offense or four hundred fifty
     9  dollars for the second or subsequent offense.
    10    § 2. This act shall take effect on the ninetieth day  after  it  shall
    11  have  become a law, and shall apply to violations committed on and after
    12  such date.
