       AN ACT to amend the education law, in relation to authorizing the  state
         library  to  coordinate  the purchase of electronic databases or other
         information resources for state agencies, libraries and other  govern-
         mental entities
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Short title. This act shall be known and may  be  cited  as
    2  the "New  York state comprehensive information system (NYSCIS) act".
    3    S  2.  Legislative  findings.  State agencies and the libraries of New
    4  York individually license and purchase electronic  databases  and  other
    5  information  resources.  Access  to information is not only vital to the
    6  functioning of our democracy, but also to creating an environment condu-
    7  cive to learning, research  and  innovation.  The  coordination  of  the
    8  selection  and  purchase  of  these resources by the state library would
    9  result in greater efficiencies and  cost  savings  for  the  public  and
   10  foster improved access to information across the state. Therefore, it is
   11  in  the  best interests of the state and its libraries to enact the "New
   12  York state comprehensive information system (NYSCIS) act".
   13    S 3. The education law is amended by adding a new section 286 to  read
   14  as follows:
   15    S  286.  NEW YORK STATE COMPREHENSIVE INFORMATION SYSTEM.  1. GENERAL.
   16  THERE IS HEREBY ESTABLISHED THE NEW YORK STATE COMPREHENSIVE INFORMATION
   17  SYSTEM (NYSCIS) TO BE ADMINISTERED BY THE  STATE  LIBRARY  TO  ENABLE  A
   18  COLLABORATIVE  AND  COST  EFFECTIVE APPROACH TO THE PROCUREMENT OF ELEC-
   19  TRONIC DATABASE AND OTHER INFORMATION RESOURCES.
   20    2. PARTICIPANTS. ENTITIES PERMITTED TO PARTICIPATE IN NYSCIS ARE STATE
   21  AGENCIES, LIBRARY SYSTEMS AND THEIR MEMBER  LIBRARIES,  AUTHORITIES  AND
   22  OTHER LOCAL GOVERNMENTAL ENTITIES.

    1    3.  STATE  CONTRACTS.  STATE AGENCIES ARE REQUIRED TO COORDINATE THEIR
    2  PROCUREMENT FOR INFORMATION RESOURCES THROUGH THE STATE LIBRARY  OR  ITS
    3  DESIGNEE.
    4    4.  RESOURCE  SELECTION.  THE  STATE  LIBRARY SHALL CREATE AN ADVISORY
    5  COMMITTEE REPRESENTATIVE OF PARTICIPANTS IN THIS  COLLABORATIVE  EFFORT,
    6  AND  WILL  BE  TASKED  WITH THE SELECTION OF INFORMATION RESOURCES TO BE
    7  INCLUDED IN NYSCIS.
    8    5. ADMINISTRATION. THE STATE LIBRARY OR ITS DESIGNEE SHALL  ADMINISTER
    9  NYSCIS AND BE PERMITTED TO RECOUP EXPENSES FOR COORDINATING THESE COLLA-
   10  BORATIVE PURCHASING AGREEMENTS.
   11    S  4. This act shall take effect six months after it shall have become
   12  a law.
