       Introduced  by  Sen.  O'MARA -- read twice and ordered printed, and when
         printed to be committed to the Committee on Investigations and Govern-
         ment Operations
       AN ACT to amend the alcoholic beverage control law, in relation to auto-
         mobile racing facilities
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  Section 3 of the alcoholic beverage control law is amended
    2  by adding a new subdivision 20-f to read as follows:
    3    20-F. "AUTOMOBILE RACING FACILITY" MEANS ANY CLOSED-COURSE MOTORSPORTS
    4  COMPLEX AND ITS ANCILLARY GROUNDS THAT HAS AT LEAST FIFTY THOUSAND FIXED
    5  SEATS  FOR  RACE PATRONS AND HOSTS AT LEAST ONE NASCAR SPRINT CUP SERIES
    6  RACE AND AT LEAST TWO OTHER NATIONALLY  RECOGNIZED  RACING  EVENTS  EACH
    7  CALENDAR YEAR.
    8    S  2.  The  opening  paragraph  of subdivision 5 of section 106 of the
    9  alcoholic beverage control law, as amended by chapter 83 of the laws  of
   10  1995, is amended to read as follows:
   11    No  alcoholic  beverages shall be sold, offered for sale or given away
   12  upon any premises licensed to sell alcoholic  beverages  at  retail  for
   13  on-premises consumption, EXCEPT AUTOMOBILE RACING FACILITIES, during the
   14  following hours:
   15    S  3.  Section 106 of the alcoholic beverage control law is amended by
   16  adding a new subdivision 5-a to read as follows:
   17    5-A. NO ALCOHOLIC BEVERAGES SHALL BE SOLD, OFFERED FOR SALE  OR  GIVEN
   18  AWAY  UPON  AN  AUTOMOBILE  RACING  FACILITY  LICENSED TO SELL ALCOHOLIC
   19  BEVERAGES AT RETAIL FOR ON-PREMISES CONSUMPTION BETWEEN FOUR ANTE  MERI-
   20  DIEM AND EIGHT ANTE MERIDIEM.
   21    S 4. This act shall take effect immediately.
