        Introduced  by  Sen. SANDERS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Veterans, Homeland Securi-
          ty and Military Affairs

        AN ACT directing the  department  of  homeland  security  and  emergency
          services to conduct a study on domestic terrorism within the state and
          to  make  recommendations to address such terrorism; and providing for
          the repeal of such provisions upon expiration thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  For the purposes of this study "domestic terrorism" shall
     2  mean the commission, or possible commission, of acts covered under arti-
     3  cle 490 of the penal law, in which the perpetrator  is  or  would  be  a
     4  resident  of  the  United States or an organization that operates exclu-
     5  sively or primarily within the United States.
     6    § 2. The department of homeland security and emergency services  shall
     7  conduct  a  study  and make recommendations to combat domestic terrorism
     8  within the state. Such study shall, at a minimum:
     9    (a) collect and organize data on the nature  and  extent  of  domestic
    10  terrorism in the state;
    11    (b) review state and federal policies and protocols related to combat-
    12  ting domestic terrorism;
    13    (c)  identify available federal, state and local programs that provide
    14  services to victims of domestic terrorism;
    15    (d) identify available federal, state and local programs that  provide
    16  services to prevent acts of domestic terrorism;
    17    (e) identify available federal, state and local programs and resources
    18  to support efforts to prevent radicalization and disrupt violent extrem-
    19  ist networks;
    20    (f)  identify  the  role social media plays in the development of such
    21  extremist networks;

     1    (g) identify gaps and establish recommendations for interagency proto-
     2  cols and collaboration between federal, state, and  local  law  enforce-
     3  ment,  state  and  governmental agencies, and non-governmental organiza-
     4  tions;
     5    (h)  evaluate  approaches  and  establish  recommendations to increase
     6  public awareness about domestic terrorism and  make  recommendations  on
     7  such  approaches, including ways by which the government can improve its
     8  sharing of information; and
     9    (i) evaluate  the  effectiveness  of  training  programs  on  domestic
    10  terrorism  that have been designed for law enforcement personnel, prose-
    11  cutors, other governmental  employees,  and  non-governmental  organiza-
    12  tions, and make recommendations for improving the quality and effective-
    13  ness of such programs.
    14    §  3.  The  study  shall  also  include recommendations for developing
    15  protocols that will address evolving threats while respecting  constitu-
    16  tionally  protected free speech and political activities and recommenda-
    17  tions to strengthen state and local efforts to prevent acts of  domestic
    18  terrorism.
    19    §  4.  The  study shall be completed and a report with any recommenda-
    20  tions shall be submitted to the governor, the temporary president of the
    21  senate, and the speaker of the assembly within one year of the effective
    22  date of this act.
    23    § 5. This act shall take effect immediately; and shall expire  and  be
    24  deemed repealed 2 years after such date.
