STATE OF NEW YORK ________________________________________________________________________ 4877 2023-2024 Regular Sessions IN SENATE February 16, 2023 ___________ Introduced by Sen. MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Procurement and Contracts AN ACT to amend the state finance law, in relation to the time frame for the implementation of contracts with not-for-profit corporations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 179-q of the state finance law is amended by adding 2 a new subdivision 8-a to read as follows: 3 8-a. "Registered contract" means a completed contract package that is 4 signed by both the state agency and not-for-profit organization and sent 5 to the attorney general for approval. 6 § 2. Subdivision 1 of section 179-s of the state finance law, as added 7 by chapter 166 of the laws of 1991, is amended to read as follows: 8 1. A state agency shall [have not more than one hundred fifty days9following the latest date on which any of the appropriations covered by10the program plan become law to execute] register contracts with not-for- 11 profit organizations pursuant to the program plan within thirty days of 12 the start date of the contract. Upon execution of each contract by the 13 state agency and the not-for-profit organization, the contract shall 14 immediately be delivered to the attorney general for approval. The 15 attorney general shall within fifteen days of receipt either approve 16 such contract or disapprove and return the contract to the state agency 17 with reasons therefor. Upon approval, the contract shall be delivered to 18 the comptroller who shall within fifteen days of receipt either approve 19 and file such contract or disapprove and return the contract to the 20 state agency with his reasons therefor. 21 § 3. Section 179-t of the state finance law is amended by adding a 22 new subdivision 6 to read as follows: 23 6. A state agency shall register renewal contracts with not-for-profit 24 organizations pursuant to the program plan within thirty days of the 25 start date of the renewed contract. 26 § 4.
