         printed to be committed to the Committee on Higher Education
       AN  ACT  to amend the education law, in relation to the certification of
         magnetic resonance imaging technicians
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The education law is amended by adding a new article 167 to
    2  read as follows:
    3                                 ARTICLE 167
    4                         MAGNETIC RESONANCE IMAGING
    5  SECTION 8800. DEFINITIONS.
    6          8801.  REQUIREMENTS  FOR  CERTIFICATION  AS A MAGNETIC RESONANCE
    7                  IMAGING TECHNICIAN.
    8    S 8800. DEFINITIONS. 1. "MAGNETIC RESONANCE IMAGING TECHNICIAN"  SHALL
    9  MEAN  AN INDIVIDUAL USING MAGNETIC RESONANCE IMAGING TO SEE SOFT AS WELL
   10  AS HARD TISSUES WITHIN THE HUMAN BODY.
   11    2. "CERTIFIED MAGNETIC RESONANCE IMAGING  TECHNICIAN"  SHALL  MEAN  AN
   12  INDIVIDUAL  WHO  HAS  SUCCESSFULLY  FULFILLED THE REQUIREMENTS TO OBTAIN
   13  MAGNETIC RESONANCE IMAGING TECHNICIAN CERTIFICATION PURSUANT TO SUBDIVI-
   14  SION ONE OF THIS SECTION.
   15    S 8801. REQUIREMENTS FOR CERTIFICATION AS A MAGNETIC RESONANCE IMAGING
   16  TECHNICIAN. 1. TO QUALIFY TO BE A MAGNETIC RESONANCE IMAGING  TECHNICIAN
   17  TECHNICIAN, AN APPLICANT SHALL FULFILL THE FOLLOWING REQUIREMENTS:
   18    A. APPLICATION: FILE AN APPLICATION WITH THE DEPARTMENT;
   19    B.  EDUCATION:  HAVE RECEIVED AN EDUCATION, INCLUDING: (I) HIGH SCHOOL
   20  GRADUATION OR A GENERAL EQUIVALENCY DIPLOMA (GED); AND  (II)  SUCCESSFUL
   21  COMPLETION OF A DEPARTMENT CERTIFICATION PROGRAM;
   22    C.  EXPERIENCE:  HAVE EXPERIENCE SATISFACTORY TO THE DEPARTMENT AND IN
   23  ACCORDANCE WITH THE COMMISSIONER'S REGULATIONS;
   24    D. EXAMINATION: PASS AN EXAMINATION SATISFACTORY TO THE DEPARTMENT AND
   25  IN ACCORDANCE WITH THE COMMISSIONER'S REGULATIONS;
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                             [ ] is old law to be omitted.

    1    E. AGE: BE AT LEAST EIGHTEEN YEARS OF AGE; AND
    2    F.  CHARACTER: BE OF GOOD MORAL CHARACTER AS DETERMINED BY THE DEPART-
    3  MENT INCLUDING HAVING NO FELONY OR DRUG RELATED CONVICTIONS.
    4    2. NO PERSON SHALL ACT AS  A  MAGNETIC  RESONANCE  IMAGING  TECHNICIAN
    5  UNLESS REGISTERED BY THE DEPARTMENT.
    6    S  2. This act shall take effect on the first of January next succeed-
    7  ing the date on which it shall have become a law. Effective immediately,
    8  the addition, amendment and/or repeal of any rule or  regulation  neces-
    9  sary  for the implementation of the provisions of this act on its effec-
   10  tive date is authorized and directed to be  made  and  completed  on  or
   11  before such effective date.
