         printed to be committed to the Committee on Labor
       AN ACT to amend the labor law, in relation to expanding  the  definition
         of explosive
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 1 of section 451 of the labor law,  as  amended
    2  by section 2 of part CC of chapter 57 of the laws of 2009, is amended to
    3  read as follows:
    4    1.  "Explosives"  means (A) gunpowder, powders used for blasting, high
    5  explosives, blasting materials, detonating fuses, detonators,  pyrotech-
    6  nics  and  other detonating agents, fireworks and dangerous fireworks as
    7  defined in section 270.00 of the penal law,  smokeless  powder  and  any
    8  chemical compound or any mechanical mixture containing any oxidizing and
    9  combustible units, or other ingredients in such proportions, quantities,
   10  or  packing  that  ignition by fire, friction, concussion, percussion or
   11  detonation of any part thereof may cause and is  intended  to  cause  an
   12  explosion,  but  shall  not include gasoline, kerosene, naphtha, turpen-
   13  tine, benzine, acetone, ethyl  ether,  benzol  or  quantities  of  black
   14  powder  not  exceeding five pounds for use in firing of antique firearms
   15  or artifacts or replicas thereof. Fixed ammunition and primers for small
   16  arms, pyrotechnic devices which are designed  for  and  being  used  for
   17  legitimate  wildlife  management  or  controls, safety fuses and matches
   18  shall not be deemed to be explosives when, as  provided  by  regulation,
   19  the  individual  units  contain  any  of the above-mentioned articles or
   20  substances in such limited quantity, of such nature and so  packed  that
   21  it  is impossible to produce an explosion of such units to the injury of
   22  life, limb or property.
   23    (B) AND INCLUDES TWO OR MORE COMPONENTS THAT ARE ADVERTISED  AND  SOLD
   24  TOGETHER WITH INSTRUCTIONS ON HOW TO COMBINE THE COMPONENTS TO CREATE AN
   25  EXPLOSIVE, AS DEFINED IN PARAGRAPH (A) OF THIS SUBDIVISION.
   26    S 2. This act shall take effect immediately.
