          printed to be committed to the Committee on Higher Education
        AN ACT to amend the education law, in relation to  state  appropriations
          for increases in tuition credit
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subparagraph 4 of paragraph h of subdivision 2  of  section
     2  355 of the education law is amended by adding a new clause (vii) to read
     3  as follows:
     4    (vii) Beginning in state fiscal year two thousand twenty--two thousand
     5  twenty-one  and  thereafter, the state shall appropriate and make avail-
     6  able general fund operating support to cover any increase in the tuition
     7  credit pursuant to section six hundred eighty-nine-a of this title annu-
     8  ally.
     9    § 2. Subparagraph 4 of paragraph h of subdivision 2 of section 355  of
    10  the  education  law is amended by adding a new closing paragraph to read
    11  as follows:
    12     Beginning in state fiscal  year  two  thousand  twenty--two  thousand
    13  twenty-one  and  thereafter, the state shall appropriate and make avail-
    14  able general fund operating support to cover any increase in the tuition
    15  credit pursuant to section six hundred eighty-nine-a of this title annu-
    16  ally.
    17    § 3. Paragraph (a) of subdivision 7 of section 6206 of  the  education
    18  law is amended by adding a new subparagraph (vi) to read as follows:
    19    (vi)  Beginning in state fiscal year two thousand twenty--two thousand
    20  twenty-one and thereafter, the state shall appropriate and  make  avail-
    21  able general fund operating support to cover any increase in the tuition
    22  credit  pursuant  to  section  six hundred eighty-nine-a of this chapter
    23  annually.
    24    § 4. Paragraph (a) of subdivision 7 of section 6206 of  the  education
    25  law is amended by adding a new closing paragraph to read as follows:
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1     Beginning  in  state  fiscal  year  two thousand twenty--two thousand
     2  twenty-one and thereafter, the state shall appropriate and  make  avail-
     3  able general fund operating support to cover any increase in the tuition
     4  credit  pursuant  to  section  six hundred eighty-nine-a of this chapter
     5  annually.
     6    §  5.  This  act shall take effect immediately; provided, however that
     7  the amendments to subparagraph 4 of paragraph  h  of  subdivision  2  of
     8  section  355  of the education law made by section one of this act shall
     9  not affect the expiration and reversion of such subparagraph pursuant to
    10  section 16 of chapter 260 of the laws of 2011,  as  amended,  when  upon
    11  such  date  section  two  of  this  act shall take effect; and provided,
    12  further that the amendments to paragraph (a) of subdivision 7 of section
    13  6206 of the education law made by section three of this  act  shall  not
    14  affect  the  expiration  and  reversion  of  such  paragraph pursuant to
    15  section 16 of chapter 260 of the laws of 2011,  as  amended,  when  upon
    16  such date section four of this act shall take effect.
