        Introduced  by  Sen. BRESLIN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation --  commit-
          tee  discharged, bill amended, ordered reprinted as amended and recom-
          mitted to said committee

        AN ACT to amend the vehicle and traffic law, in relation  to  the  iden-
          tification of transportation network company drivers and vehicles

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1.  Subdivision 5 of section 1692 of the vehicle  and  traffic
     2  law,  as  added  by  section  2 of part AAA of chapter 59 of the laws of
     3  2017, is amended to read as follows:
     4    5. A TNC's digital network shall display a picture of the TNC  driver,
     5  and  provide  the make, model, color and license plate number of the TNC
     6  vehicle utilized for providing  the  TNC  prearranged  trip  before  the
     7  passenger enters the TNC vehicle.  The digital network shall also enable
     8  the passenger to scan, with the passenger's mobile device, the vehicle's
     9  scanable  code  decal  required by section sixteen hundred ninety-six of
    10  this article, prior to entering the vehicle and prior to the release  of
    11  payment,  in order to confirm that the vehicle is the one authorized for
    12  the passenger's prearranged trip.
    13    § 2. Paragraph (c) of subdivision 1 and subdivision 5 of section  1696
    14  of  the  vehicle  and  traffic law, as added by section 2 of part AAA of
    15  chapter 59 of the laws of 2017, are amended and a new subdivision  6  is
    16  added to read as follows:
    17    (c)  Upon  review  of all information received and retained by the TNC
    18  and upon verifying that the individual is not disqualified  pursuant  to
    19  this  section  from receiving a TNC driver permit, a TNC may issue a TNC
    20  driver permit to the applicant. The TNC  shall  review  all  information
    21  received  relating  to  such applicant and hold such information for six
    22  years along with  a  certification  that  such  applicant  qualifies  to
    23  receive  a TNC driver permit. The department shall design and promulgate

     1  a TNC driver identification card to be issued by a TNC when such TNC  is
     2  issuing  a TNC driver permit to an applicant.  Such TNC driver identifi-
     3  cation card shall at a minimum include the TNC driver's name, photograph
     4  and  license plate number. A TNC driver who is providing the TNC service
     5  or TNC prearranged trip shall prominently display such TNC driver  iden-
     6  tification card in the TNC vehicle.
     7    5. The department shall promulgate regulations to ensure that each TNC
     8  vehicle  is easily identified as such and that the TNC for which the TNC
     9  driver is providing the TNC service or TNC prearranged trip  is  distin-
    10  guishable.  Such  marking  shall  be  in such form as is approved by the
    11  commissioner, which shall at a minimum include an illuminated sign indi-
    12  cating the TNC for which the TNC driver is providing the TNC service  or
    13  TNC  prearranged  trip,  and  shall be attached, affixed or displayed in
    14  such manner as he or she may prescribe by regulation.
    15    6. The department shall promulgate regulations  to  require  each  TNC
    16  company to provide each TNC driver with a scanable code decal, such as a
    17  quick  response  or  QR  code  decal,  and  to require such decals to be
    18  displayed on the outside of each  TNC  vehicle.  Such  decals  shall  be
    19  designed  to allow the passenger to confirm, prior to entering the vehi-
    20  cle, that the vehicle is the  authorized  vehicle  for  the  passenger's
    21  prearranged trip, using the TNC's digital network as set forth in subdi-
    22  vision five of section sixteen hundred ninety-two of this article.
    23    §  3.  This  act shall take effect on the thirtieth day after it shall
    24  have become a law; provided, however that section one of this act  shall
    25  take  effect on the one hundred eightieth day after it shall have become
    26  a law.  Effective immediately, the addition, amendment and/or repeal  of
    27  any  rule  or regulation necessary for the implementation of this act on
    28  its effective date are authorized to be made and completed on or  before
    29  such effective date.
