JOHNSON, KRUEGER, THOMPSON, VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Development and Small Business -- reported favora- bly from said committee and committed to the Committee on Finance -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT creating an economic development benefit task force; and provid- ing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The legislature finds and declares that in order for the 2 state to emerge into the next decade as a strong economic power, it must 3 revisit the successes and failures of the empire zone program. Due to 4 the nearing expiration of the program it is imperative for the state and 5 all relevant parties to come together and determine what are the best 6 options for a new economic development benefit policy that will help 7 make New York state's businesses be as competitive as possible on the 8 national and world stage. In the creation of a new economic development 9 benefit program the following issues must be reviewed: 10 (a) Identification of strategic industries; 11 (b) Roles of federal, state and local government in economic develop- 12 ment; 13 (c) Business expansion and investment; 14 (d) Business retention; 15 (e) Business attraction; 16 (f) Innovation, commercialization and emerging business; 17 (g) Urban revitalization; 18 (h) Minority- and women-owned business enterprises; 19 (i) Examination of current programs and incentives; 20 (j) Review of best practices; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. (a) An economic development benefit task force is hereby created 5 to conduct the examination described in section one of this act and 6 recommend the best economic development benefit program for the state. 7 (b) The task force shall consist of 29 members, each shall be 8 appointed for a term of one year, consisting of nine members appointed 9 by the governor, six members from the temporary president of the senate, 10 six members from the speaker of the assembly, two members from the 11 minority leader of the senate and two members from the minority leader 12 of the assembly. Such members shall be chosen from regional business 13 organizations, business improvement districts, private sector organiza- 14 tions, non-profits, unions, universities, colleges and statewide busi- 15 ness advocacy organizations. The commissioners of the departments of 16 economic development, environmental conservation and labor, and the 17 director of the New York state foundation for science, technology and 18 innovation shall be ex-officio members. The governor shall designate the 19 chairman and vice-chairman from among his or her appointees. Vacancies 20 in the membership of the commission and among its officers shall be 21 filled in the manner provided for original appointments. 22 (c) The task force may use employees at the department of economic 23 development as it may deem necessary for the performance of its func- 24 tions. 25 (d) The task force may meet within and without the state, shall hold 26 public hearings, and shall have all the powers of a legislative commit- 27 tee pursuant to the legislative law. 28 (e) The members of the task force shall receive no compensation for 29 their services, but shall be allowed their actual and necessary expenses 30 incurred in the performance of their duties pursuant to this act. 31 (f) To the maximum extent feasible, the task force shall be entitled 32 to request and receive and shall utilize and be provided with such 33 facilities, resources, and data of any court, department, division, 34 board, bureau, commission, or agency of the state or any political 35 subdivision thereof as it may reasonably request to carry out properly 36 its powers and duties pursuant to this act. 37 (g) The appointing authorities shall appoint the members of the 38 economic development benefit task force on or before 30 days after this 39 act shall have become a law and the task force shall convene its first 40 meeting on or before 30 days thereafter. 41 (h) The task force shall issue a preliminary report to the governor 42 and legislature of its findings, conclusions, and recommendations by the 43 ninetieth day after this act shall take effect and a final report of its 44 findings, conclusions, and recommendations not later than the one 45 hundred fiftieth day after this act shall take effect. 46 S 3. This act shall take effect on the thirtieth day after it shall 47 have become a law and shall expire and be deemed repealed June 30, 2010.
