        AN ACT to amend the environmental conservation law and  the  administra-
          tive  code  of  the  city  of  New York, in relation to establishing a
          computerized database containing information relating to  the  storage
          and  handling  of  hazardous substances and emergency responses to the
          release of hazardous substances

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Section  3-0301  of the environmental conservation law is
     2  amended by adding a new subdivision 6 to read as follows:
     3    6. a. The commissioner shall maintain a computerized data system which
     4  shall contain information  relating  to  the  storage  and  handling  of
     5  hazardous substances and emergency responses to the release of hazardous
     6  substances  by  any agency or responsible person. This system shall have
     7  access to information stored on other computerized  data  systems  main-
     8  tained  by  agencies,  which information shall collectively include, but
     9  not be limited to, the following:
    10    (1) the date and time of all notifications received by the commission-
    11  er pursuant to this chapter and all relevant rules of the department and
    12  the information contained in such notifications;
    13    (2) the date and time of notifications received by the police and fire
    14  departments, the emergency medical service, the department of  transpor-
    15  tation and any other agency with respect to the transport and release of
    16  hazardous substances and the information contained in such notification;
    17    (3)  the  date, time and location of all response measures, undertaken
    18  or ordered to be undertaken pursuant to this chapter, a  description  of
    19  such  response  measures, the hazardous substance or substances released
    20  and the quantity of each hazardous substance released;
    21    (4) the location of all pipelines within the city which  transport  or
    22  are  intended  to  transport  any  hazardous substance, petroleum or any

     1  petroleum product and for each such pipeline the location of every valve
     2  or other control device which may be used to interrupt the transport  of
     3  such material and the owner or operator of such pipeline;
     4    (5)  the information required to be reported pursuant to article forty
     5  of this chapter; and
     6    (6) the inventory database compiled by the  commissioner  pursuant  to
     7  article forty of this chapter.
     8    b.  All of the information required by paragraph a of this subdivision
     9  shall be made available on-line in read-only form to personnel from  any
    10  agency,  members  of  the legislature and legislative staff and shall be
    11  made available to members of the public.
    12    § 2. The administrative code of the city of New  York  is  amended  by
    13  adding a new section 24-613 to read as follows:
    14    § 24-613 Computerized  database.  a. The commissioner shall maintain a
    15  computerized data system which shall contain information relating to the
    16  storage and handling of hazardous substances and emergency responses  to
    17  the release of hazardous substances by any agency or responsible person.
    18  This  system  shall have access to information stored on other computer-
    19  ized data  systems  maintained  by  agencies,  which  information  shall
    20  collectively include, but not be limited to, the following:
    21    (1) the date and time of all notifications received by the commission-
    22  er pursuant to this chapter and all relevant rules of the department and
    23  the information contained in such notifications;
    24    (2) the date and time of notifications received by the police and fire
    25  departments,  the emergency medical service, the department of transpor-
    26  tation and any other agency with respect to the transport and release of
    27  hazardous substances and the information contained in such notification;
    28    (3) the date, time and location of all response  measures,  undertaken
    29  or  ordered  to be undertaken pursuant to this chapter, a description of
    30  such response measures, the hazardous substance or  substances  released
    31  and the quantity of each hazardous substance released;
    32    (4)  the  location of all pipelines within the city which transport or
    33  are intended to transport any  hazardous  substance,  petroleum  or  any
    34  petroleum product and for each such pipeline the location of every valve
    35  or  other control device which may be used to interrupt the transport of
    36  such material and the owner or operator of such pipeline;
    37    (5) the information required to be reported pursuant to section 24-706
    38  of this title; and
    39    (6) the citywide facility inventory database compiled by  the  commis-
    40  sioner pursuant to section 24-707 of this title.
    41    b.  All  of  the information required by subdivision a of this section
    42  shall be made available on-line in read-only form to personnel from  any
    43  agency,  members  of  the  council  and  council staff and shall be made
    44  available to members of the public.
    45    § 3. This act shall take effect on the ninetieth day  after  it  shall
    46  have become a law. Effective immediately, the addition, amendment and/or
    47  repeal  of  any  rule  or regulation necessary for the implementation of
    48  this act on its effective date are authorized to be made  and  completed
    49  on or before such effective date.
