       AN  ACT  to  amend  the  social  services  law, in relation to providing
         managed care enrollees access to the services of the  foot  center  of
         New York
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.   Clause (F) of subparagraph  (iii)  of  paragraph  (a)  of
    2  subdivision 4 of section 364-j of the social services law, as relettered
    3  by  chapter  37  of the laws of 2010, is relettered clause (G) and a new
    4  clause (F) is added to read as follows:
    5    (F) THE SERVICES ARE PODIATRIC SERVICES AND ARE PROVIDED BY A DIAGNOS-
    6  TIC AND TREATMENT CENTER LICENSED BY ARTICLE TWENTY-EIGHT OF THE  PUBLIC
    7  HEALTH  LAW  WHICH IS AFFILIATED WITH AN ACADEMIC PODIATRIC CENTER WHICH
    8  HAS  BEEN  GRANTED  AN  OPERATING  CERTIFICATE   PURSUANT   TO   ARTICLE
    9  TWENTY-EIGHT  OF  THE  PUBLIC  HEALTH  LAW  TO  PROVIDE  SUCH  PODIATRIC
   10  SERVICES.  ANY  DIAGNOSTIC  AND  TREATMENT  CENTER  PROVIDING  PODIATRIC
   11  SERVICES  PURSUANT TO THIS CLAUSE SHALL PRIOR TO JUNE FIRST OF EACH YEAR
   12  REPORT TO THE GOVERNOR, TEMPORARY PRESIDENT OF THE SENATE AND SPEAKER OF
   13  THE ASSEMBLY ON THE FOLLOWING:  THE  TOTAL  NUMBER  OF  VISITS  MADE  BY
   14  MEDICAL  ASSISTANCE RECIPIENTS DURING THE IMMEDIATELY PRECEDING CALENDAR
   15  YEAR; THE NUMBER OF VISITS MADE BY MEDICAL ASSISTANCE RECIPIENTS  DURING
   16  THE  IMMEDIATELY PRECEDING CALENDAR YEAR BY RECIPIENTS WHO WERE ENROLLED
   17  IN MANAGED CARE PROGRAMS; THE NUMBER OF VISITS MADE BY  MEDICAL  ASSIST-
   18  ANCE RECIPIENTS DURING THE IMMEDIATELY PRECEDING CALENDAR YEAR BY RECIP-
   19  IENTS  WHO WERE ENROLLED IN MANAGED CARE PROGRAMS THAT PROVIDE PODIATRIC
   20  BENEFITS AS A COVERED SERVICE; AND THE NUMBER  OF  VISITS  MADE  BY  THE
   21  UNINSURED DURING THE IMMEDIATELY PRECEDING CALENDAR YEAR; OR
   22    S  2.  This  act shall take effect immediately, provided however, that
   23  the amendments to section 364-j of  the  social  services  law  made  by
   24  section  one of this act shall not affect the repeal of such section and
   25  shall be deemed to be repealed therewith.
