          printed to be committed to  the  Committee  on  Finance  --  committee

          passed  by Senate and delivered to the Assembly, recalled, vote recon-
          sidered, restored to third reading,  amended  and  ordered  reprinted,
          retaining its place in the order of third reading

        AN  ACT  to amend the executive law, in relation to the authority of the
          New York black car operators' injury compensation fund, inc.

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Section 160-ii of the executive law is amended by adding a
     2  new subdivision 5 to read as follows:
     3    5. The fund shall have the  authority  to  provide  additional  health
     4  benefits, consistent with its plan of operation, for all black car oper-
     5  ators  entitled thereto pursuant to this chapter, provided that the fund
     6  shall  have  complied  with  all  applicable  statutory  and  regulatory
     7  requirements.  The  surcharge amount not related to payments of workers'
     8  compensation claims and the administration  of  those  claims  shall  be
     9  one-half of one percent (0.5%).
    10    § 2. This act shall take effect immediately.
