       Introduced  by  Sen.  SKELOS -- read twice and ordered printed, and when
         printed to be committed  to  the  Committee  on  Local  Government  --
         committee  discharged,  bill amended, ordered reprinted as amended and
         recommitted to said committee
       AN ACT to amend the real property tax law, in relation to adjusted  base
         proportions for the city of Long Beach in the county of Nassau
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (a) of subdivision 3 of section 1903 of the  real
    2  property  tax  law is amended by adding a new subparagraph (xii) to read
    3  as follows:
    4    (XII) NOTWITHSTANDING ANY OTHER PROVISION  OF  LAW,  IN  THE  APPROVED
    5  ASSESSING  UNIT  OF  THE CITY OF LONG BEACH IN THE COUNTY OF NASSAU, AND
    6  FOR CURRENT BASE PROPORTIONS TO BE DETERMINED BY  TAXES  BASED  ON  SUCH
    7  APPROVED  ASSESSING UNIT'S TWO THOUSAND TEN ASSESSMENT ROLL, THE CURRENT
    8  BASE PROPORTION OF ANY CLASS SHALL NOT EXCEED THE ADJUSTED BASE  PROPOR-
    9  TION OR ADJUSTED PROPORTION, WHICHEVER IS APPROPRIATE, OF THE IMMEDIATE-
   10  LY  PRECEDING  YEAR.   WHERE THE COMPUTATION OF CURRENT BASE PROPORTIONS
   11  WOULD OTHERWISE PRODUCE SUCH RESULT, THE CURRENT BASE PROPORTION OF SUCH
   12  CLASS OR CLASSES SHALL BE LIMITED  TO  ZERO  PERCENT  INCREASE  AND  THE
   13  LEGISLATIVE  BODY  OF  THE AFOREMENTIONED APPROVED ASSESSING UNIT OF THE
   14  CITY OF LONG BEACH, IN THE COUNTY OF NASSAU,  SHALL  ALTER  THE  CURRENT
   15  BASE  PROPORTION  OF  EITHER  CLASS  SO THAT THE SUM OF THE CURRENT BASE
   16  PROPORTIONS EQUALS ONE;
   17    S 2. This act shall take effect immediately and  shall  apply  to  the
   18  levy of taxes based on the 2010 assessment roll in an approved assessing
   19  unit.
