        Introduced  by  Sen.  KAPLAN -- read twice and ordered printed, and when
          printed to be committed to the Committee on Education

        AN ACT to amend the education law, in relation to establishing an educa-
          tional program related to the prevention of anti-Semitism and discrim-
          ination based on religion, race, sexual orientation or gender identity

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Section 305 of the education law is amended by adding a new
     2  subdivision 59 to read as follows:
     3    59.  Notwithstanding  any  other provision of law to the contrary, and
     4  subject to an appropriation,  the  department  shall  contract  with  an
     5  outside  entity who has expertise in the prevention of anti-Semitism and
     6  discrimination based on religion, race,  sexual  orientation  or  gender
     7  identity to establish an anti-Semitism and discrimination prevention and
     8  education  program  overseen  by such department. The commissioner shall
     9  work with such outside entity, to establish and develop  an  educational
    10  program  within  such department related to the prevention of anti-Semi-
    11  tism and discrimination based on religion, race, sexual  orientation  or
    12  gender  identity  in  grades  kindergarten  through twelve. Such program
    13  shall be further defined by such commissioner in regulation and shall be
    14  designed to educate students, parents and  school  personnel  about  the
    15  prevention  of anti-Semitism and discrimination based on religion, race,
    16  sexual orientation or gender identity.  Such  commissioner,  in  collab-
    17  oration  with  any  other  stakeholder groups deemed appropriate by such
    18  commissioner, shall develop:
    19    a. the  anti-Semitism  and  discrimination  prevention  and  education
    20  program  prepared by an outside expert organization into age-appropriate
    21  model curriculum resources, including exemplar lesson  plans,  and  best
    22  practice  instructional  resources  for  students,  parents  and  school
    23  personnel designed to prevent anti-Semitism and discrimination based  on
    24  religion,  race,  sexual  orientation  or  gender  identity.  Such model
    25  curriculum, resources, lesson plans and  instructional  resources  shall
    26  include  but  not  be  limited  to guidelines and methods of prevention,
    27  indicators and warning signs of anti-Semitism and  discrimination  based

     1  on religion, race, sexual orientation or gender identity, guidelines and
     2  methods  to  prevent anti-Semitism and discrimination based on religion,
     3  race, sexual orientation or gender identity and how to report complaints
     4  of  anti-Semitism  and  discrimination  based  on religion, race, sexual
     5  orientation or gender identity. Such  model  curriculum  shall  be  made
     6  available  to  school boards, school superintendents, their equivalents,
     7  and teachers for voluntary implementation in social studies classes  and
     8  in social studies coursework;
     9    b.  instructional tools and materials for students, parents and school
    10  personnel, which shall include updated  information  on  how  to  report
    11  incidents  of  anti-Semitism and discrimination based on religion, race,
    12  sexual orientation or gender identity, with a review of such information
    13  to occur periodically, at intervals deemed appropriate by  such  commis-
    14  sioner; and
    15    c.  public  availability of all materials related to the anti-Semitism
    16  and discrimination prevention and education program on such department's
    17  website in Spanish, Creole, Mandarin,  Korean,  Bengali  and  any  other
    18  language predominantly spoken by the population of the state.
    19    §  2.  This act shall take effect on the first of July next succeeding
    20  the date on which it shall have become a law. Effective immediately, the
    21  addition, amendment and/or repeal of any rule  or  regulation  necessary
    22  for  the implementation of this act on its effective date are authorized
    23  to be made and completed on or before such effective date.
