        Introduced  by  Sen.  HOYLMAN-SIGAL  -- (at request of the Department of
          Agriculture and Markets) -- read twice and ordered printed,  and  when
          printed to be committed to the Committee on Agriculture

        AN  ACT to amend the agriculture and markets law, in relation to supple-
          mental labeling for treated seeds

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Section 136 of the agriculture and markets law is amended
     2  by adding a new subdivision 8-a to read as follows:
     3    8-a. The term "supplemental labeling" refers to  information  that  is
     4  required  to  be  supplied to the end user of agricultural and vegetable
     5  seed when sold or otherwise exchanged in  commercial  quantities,  which
     6  may  include,  among other things, instructions and warnings intended to
     7  safeguard end user health, public health and/or the general  quality  of
     8  the  environment,  including  water  quality  and  the protection of off
     9  target organisms and sites. Supplemental labeling need not  be  attached
    10  to  the  seed  container,  and may take the form of, among other things,
    11  package inserts, information sheets, information displays or other means
    12  of communication, approved by the commissioner.
    13    § 2. Paragraph 3 of subdivision A of section 137  of  the  agriculture
    14  and markets law, as added by chapter 631 of the laws of 1955, is amended
    15  to read as follows:
    16    3.  If  seed  has  received  an  application of a substance harmful to
    17  humans [or], other vertebrates or that may negatively impact  the  envi-
    18  ronment  or  off  target  organisms  in  the  quantities used, a warning
    19  adequate to protect the [public] handler, end user and the public  shall
    20  be required. Such warning may be incorporated into the seed packaging or
    21  may be supplied as a supplemental label.
    22    §  3.  Subdivision A of section 137 of the agriculture and markets law
    23  is amended by adding a new paragraph 4 to read as follows:

     1    4. The seller shall  maintain  a  record  of  any  supplemental  label
     2  supplied for seed subject to the requirements of paragraph three of this
     3  subdivision for a period of three years.
     4    § 4. This act shall take effect on the one hundred eightieth day after
     5  it shall have become a law.
