Subparagraph (xiv) of paragraph (a) of subdivision 13 of section 24 106 of the alcoholic beverage control law, as added by chapter 429 of 25 the laws of 2019, is amended and a new subparagraph (xvi) is added to 26 read as follows: 27 [(xiv)] (xv) ALSO ALL THOSE TRACTS OR PARCEL OF LAND, situate in the 28 City of Saratoga Springs, County of Saratoga and State of New York, 29 bounded and described as follows: Starting at an iron pipe on the south- 30 erly side of New York State Highway 9P at the intersection of the lands 31 now of formerly of Ernst and one Walbridge and runs thence along the 32 said highway S 64 degrees 25' E 72.4 feet to a concrete state monument; 33 thence S 35 degrees 9' E 135.6 feet to an iron pipe on the Westerly side 34 of an 18 foot wide Right of Way extending from the aforementioned high- 35 way to the Low Water Mark of Saratoga Lake; thence along the said Right 36 of Way S 17 degrees 20' W 115 feet to an iron pipe, the place of begin- 37 ning; thence in the same straight line along the said Right of Way 78.4 38 feet to an iron pipe; thence still along the said Right of Way S 38 39 degrees 9' W 208 feet to an iron pipe; thence N 51 degrees 51' W 81 feet 40 to an iron pipe; thence N 14 degrees 34' E 54.2 feet to an iron pipe; 41 thence N 56 degrees 0' E 242.8 feet to the place of beginning, the 42 aforementioned dimensions more or less; and being further bounded and 43 described as follows: BEGINNING at an iron pipe of the southerly side of 44 New York State Highway 9P at the intersection of the lands now of 45 formerly of Ernst and one Walbridge and runs thence along said highway 46 S. 64 degrees 25' E. 72.4 feet to a concrete state monument; thence 47 still along the said highway S. 35 degrees 9' E. 135.6 feet to an iron 48 pipe on the westerly side of a Right of Way 18 feet wide running from 49 the beforementioned highway to the Low Water Mark of Saratoga Lake; 50 thence across the said Right of Way S. 26 degrees E. 21.15 feet to the 51 Easterly side of the said Right of Way, the place of beginning; thence 52 along the said Right of Way S. 17 degrees 20' W. 171.1 feet to a point; 53 thence still along the said Right of Way S. 38 degrees 9' W. to the Low 54 Water Mark of Saratoga Lake; thence along the Low Water Mark of the said 55 lake to an iron pipe on the Westerly side of the said Highway which 56 point is about 435 feet Easterly at right angles from the Easterly sideS. 8087--B 8 1 of the beforementioned Right of Way; thence along the said Highway N. 10 2 degrees 57' W. 653.5 feet to a concrete monument; thence N. 26 degrees 3 10' W. 9.85 feet to the place of beginning. Be the aforesaid dimensions 4 in this clause more or less and encompassing lands considered to be a 5 single parcel[.]; or 6 (xvi) where such licensed wholesaler or manufacturer also has an 7 interest in any such premises or business constituting the overnight 8 lodging and resort facility located wholly within the boundaries of that 9 tract or parcel of land situate in the city of Canandaigua, county of 10 Ontario, beginning at a point in the northerly line of village lot nine 11 where it meets with South Main Street, thence south sixty-nine degrees 12 fifty-four minutes west a distance of nine hundred sixteen and twenty- 13 three hundredths feet to an iron pin; thence in the same course a 14 distance of fourteen feet to an iron pin; thence in the same course a 15 distance of fourteen and four-tenths feet to a point; thence south 16 fifteen degrees thirty-eight minutes and forty seconds east a distance 17 of four hundred forty-six and eighty-seven hundredths feet to a point; 18 thence south twenty-eight degrees thirty-seven minutes and fifty seconds 19 east a distance of one hundred thirteen and eighty-four hundredths feet 20 to a point; thence south eighty-five degrees and forty-seven minutes 21 east a distance of forty-seven and sixty-one hundredths feet to an iron 22 pin; thence on the same course a distance of three hundred and sixty- 23 five feet to an iron pin; thence north seventeen degrees twenty-one 24 minutes and ten seconds east a distance of four hundred fifty-seven and 25 thirty-two hundredths feet to an iron pin; thence north nineteen degrees 26 and thirty minutes west a distance of two hundred and forty-eight feet 27 to a point; thence north sixty-nine degrees and fifty-four minutes east 28 a distance of two hundred eighty-four and twenty-six hundredths feet to 29 a point; thence north nineteen degrees and thirty minutes west a 30 distance of sixty feet to the point and place of beginning, provided 31 that such facility maintains not less than seventy-five rooms and suites 32 for overnight lodging. 33 § 5. This act shall take effect immediately.
