STATE OF NEW YORK ________________________________________________________________________ 8346 IN SENATE May 15, 2020 ___________ Introduced by Sen. METZGER -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to availability of air transport ambulance service providers to store and distribute blood The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public health law is amended by adding a new section 2 3003-e to read as follows: 3 § 3003-e. Availability of air transport ambulance service providers to 4 store and distribute blood. 1. Any ambulance provider as licensed pursu- 5 ant to this article that provides air transport services, shall be 6 authorized to store human blood at all their facilities and distribute 7 human blood while providing air transport services; provided, however, 8 the only personnel on the aircraft that shall distribute the human blood 9 when transporting a patient via the aircraft shall be a registered nurse 10 who is currently licensed to practice as a registered nurse within the 11 state. 12 2. Notwithstanding any other provision of law, rule or regulation to 13 the contrary, any ambulance provider as licensed pursuant to this arti- 14 cle that provides air transport services, shall store and distribute 15 human blood in accordance with the standards set forth by section thir- 16 ty-one hundred of this chapter; provided, however, an ambulance provider 17 shall meet or exceed all standards for the storage of blood products set 18 forth by the United States Food and Drug Administration, and recommended 19 by an internationally recognized, not-for-profit association represent- 20 ing individuals and institutions involved in the fields of transfusion 21 medicine and cellular therapies. 22 § 2.
