STATE OF NEW YORK ________________________________________________________________________ 8540 IN SENATE March 10, 2022 ___________ Introduced by Sen. GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to the qualifica- tion for holding the office of assistant district attorney in the county of Oneida The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3 of the public officers law is amended by adding a 2 new subdivision 72 to read as follows: 3 72. In the county of Oneida, the provisions of this section requiring 4 a person to be a resident of the political subdivision or municipal 5 corporation of the state for which he or she shall be chosen or within 6 which his or her official functions are required to be exercised, shall 7 not prevent a person from holding the office of assistant district 8 attorney, provided that such person resides in Oneida county or in an 9 adjoining county within the state of New York; provided, however, that 10 any person performing such functions or holding the office of assistant 11 district attorney in any other county shall be a resident of such county 12 unless otherwise provided by law. The provisions of this subdivision 13 shall not apply to any person holding the office of first assistant 14 district attorney or chief assistant district attorney, the holder of 15 which would assume the duties of the district attorney upon the district 16 attorney's absence from the county or upon the district attorney's 17 inability to perform his or her duties. 18 § 2.
