A BILL
To amend section 4501.21 and to enact section 1
4503.524 of the Revised Code to create Power 2
Squadron license plates.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.524 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.493, 4503.494, 4503.496, 4503.498, 4503.499, 10
4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 4503.522, 11
4503.523, 4503.524, 4503.531, 4503.545, 4503.55, 4503.551, 12
4503.552, 4503.553, 4503.561, 4503.562, 4503.591, 4503.67, 13
4503.68, 4503.69, 4503.71, 4503.711, 4503.712, 4503.72, 4503.73, 14
4503.74, 4503.75, 4503.85, 4503.89, and 4503.92 of the Revised 15
Code. 16

       (B) The registrar shall pay the contributions the registrar 17
collects in the fund as follows: 18

        The registrar shall pay the contributions received pursuant 19
to section 4503.491 of the Revised Code to the breast cancer fund 20
of Ohio, which shall use that money only to pay for programs that 21
provide assistance and education to Ohio breast cancer patients 22
and that improve access for such patients to quality health care 23
and clinical trials and shall not use any of the money for 24
abortion information, counseling, services, or other 25
abortion-related activities. 26

        The registrar shall pay the contributions received pursuant 27
to section 4503.493 of the Revised Code to the autism society of 28
Ohio, which shall use the contributions for programs and autism 29
awareness efforts throughout the state. 30

       The registrar shall pay the contributions the registrar 31
receives pursuant to section 4503.494 of the Revised Code to the 32
national multiple sclerosis society for distribution in equal 33
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 34
chapters of the national multiple sclerosis society. These 35
chapters shall use the money they receive under this section to 36
assist in paying the expenses they incur in providing services 37
directly to their clients.38

       The registrar shall pay the contributions the registrar 39
receives pursuant to section 4503.496 of the Revised Code to the 40
Ohio sickle cell and health association, which shall use the 41
contributions to help support educational, clinical, and social 42
support services for adults who have sickle cell disease.43

       The registrar shall pay the contributions the registrar 44
receives pursuant to section 4503.498 of the Revised Code to 45
special olympics Ohio, inc., which shall use the contributions for 46
its programs, charitable efforts, and other activities. 47

       The registrar shall pay the contributions the registrar 48
receives pursuant to section 4503.499 of the Revised Code to the 49
children's glioma cancer foundation, which shall use the 50
contributions for its research and other programs. 51

        The registrar shall pay the contributions the registrar 52
receives pursuant to section 4503.50 of the Revised Code to the 53
future farmers of America foundation, which shall deposit the 54
contributions into its general account to be used for educational 55
and scholarship purposes of the future farmers of America 56
foundation. 57

        The registrar shall pay the contributions the registrar 58
receives pursuant to section 4503.501 of the Revised Code to the 59
4-H youth development program of the Ohio state university 60
extension program, which shall use those contributions to pay the 61
expenses it incurs in conducting its educational activities. 62

        The registrar shall pay the contributions received pursuant 63
to section 4503.502 of the Revised Code to the Ohio cattlemen's 64
foundation, which shall use those contributions for scholarships 65
and other educational activities. 66

       The registrar shall pay the contributions received pursuant 67
to section 4503.505 of the Revised Code to the organization Ohio 68
region phi theta kappa, which shall use those contributions for 69
scholarships for students who are members of that organization. 70

        The registrar shall pay each contribution the registrar 71
receives pursuant to section 4503.51 of the Revised Code to the 72
university or college whose name or marking or design appears on 73
collegiate license plates that are issued to a person under that 74
section. A university or college that receives contributions from 75
the fund shall deposit the contributions into its general 76
scholarship fund. 77

        The registrar shall pay the contributions the registrar 78
receives pursuant to section 4503.522 of the Revised Code to the 79
"friends of Perry's victory and international peace memorial, 80
incorporated," a nonprofit corporation organized under the laws of 81
this state, to assist that organization in paying the expenses it 82
incurs in sponsoring or holding charitable, educational, and 83
cultural events at the monument. 84

       The registrar shall pay the contributions the registrar 85
receives pursuant to section 4503.523 of the Revised Code to the 86
fairport lights foundation, which shall use the money to pay for 87
the restoration, maintenance, and preservation of the lighthouses 88
of fairport harbor. 89

       The registrar shall pay the contributions the registrar 90
receives pursuant to section 4503.524 of the Revised Code to the 91
United States power squadron districts seven, eleven, twenty-four, 92
and twenty-nine in equal amounts. Each power squadron district 93
shall use the money it receives under this section to pay for the 94
educational boating programs each district holds or sponsors 95
within this state.96

       The registrar shall pay the contributions the registrar 97
receives pursuant to section 4503.531 of the Revised Code to the 98
thank you foundation, incorporated, a nonprofit corporation 99
organized under the laws of this state, to assist that 100
organization in paying for the charitable activities and programs 101
it sponsors in support of United States military personnel, 102
veterans, and their families.103

        The registrar shall pay the contributions the registrar 104
receives pursuant to section 4503.55 of the Revised Code to the 105
pro football hall of fame, which shall deposit the contributions 106
into a special bank account that it establishes and which shall be 107
separate and distinct from any other account the pro football hall 108
of fame maintains, to be used exclusively for the purpose of 109
promoting the pro football hall of fame as a travel destination. 110

        The registrar shall pay the contributions that are paid to 111
the registrar pursuant to section 4503.545 of the Revised Code to 112
the national rifle association foundation, which shall use the 113
money to pay the costs of the educational activities and programs 114
the foundation holds or sponsors in this state. 115

        The registrar shall pay to the Ohio pet fund the 116
contributions the registrar receives pursuant to section 4503.551 117
of the Revised Code and any other money from any other source, 118
including donations, gifts, and grants, that is designated by the 119
source to be paid to the Ohio pet fund. The Ohio pet fund shall 120
use the moneys it receives under this section to support programs 121
for the sterilization of dogs and cats and for educational 122
programs concerning the proper veterinary care of those animals, 123
and for expenses of the Ohio pet fund that are reasonably 124
necessary for it to obtain and maintain its tax-exempt status and 125
to perform its duties. 126

        The registrar shall pay the contributions the registrar 127
receives pursuant to section 4503.552 of the Revised Code to the 128
rock and roll hall of fame and museum, incorporated. 129

        The registrar shall pay the contributions the registrar 130
receives pursuant to section 4503.553 of the Revised Code to the 131
Ohio coalition for animals, incorporated, a nonprofit corporation. 132
Except as provided in division (B) of this section, the coalition 133
shall distribute the money to its members, and the members shall 134
use the money only to pay for educational, charitable, and other 135
programs of each coalition member that provide care for unwanted, 136
abused, and neglected horses. The Ohio coalition for animals may 137
use a portion of the money to pay for reasonable marketing costs 138
incurred in the design and promotion of the license plate and for 139
administrative costs incurred in the disbursement and management 140
of funds received under this section. 141

        The registrar shall pay the contributions the registrar 142
receives pursuant to section 4503.561 of the Revised Code to the 143
state of Ohio chapter of ducks unlimited, inc., which shall 144
deposit the contributions into a special bank account that it 145
establishes. The special bank account shall be separate and 146
distinct from any other account the state of Ohio chapter of ducks 147
unlimited, inc., maintains and shall be used exclusively for the 148
purpose of protecting, enhancing, restoring, and managing wetlands 149
and conserving wildlife habitat. The state of Ohio chapter of 150
ducks unlimited, inc., annually shall notify the registrar in 151
writing of the name, address, and account to which such payments 152
are to be made. 153

        The registrar shall pay the contributions the registrar 154
receives pursuant to section 4503.562 of the Revised Code to the 155
Mahoning river consortium, which shall use the money to pay the 156
expenses it incurs in restoring and maintaining the Mahoning river 157
watershed. 158

        The registrar shall pay to a sports commission created 159
pursuant to section 4503.591 of the Revised Code each contribution 160
the registrar receives under that section that an applicant pays 161
to obtain license plates that bear the logo of a professional 162
sports team located in the county of that sports commission and 163
that is participating in the license plate program pursuant to 164
division (E) of that section, irrespective of the county of 165
residence of an applicant. 166

        The registrar shall pay to a community charity each 167
contribution the registrar receives under section 4503.591 of the 168
Revised Code that an applicant pays to obtain license plates that 169
bear the logo of a professional sports team that is participating 170
in the license plate program pursuant to division (G) of that 171
section. 172

        The registrar shall pay the contributions the registrar 173
receives pursuant to section 4503.67 of the Revised Code to the 174
Dan Beard council of the boy scouts of America. The council shall 175
distribute all contributions in an equitable manner throughout the 176
state to regional councils of the boy scouts. 177

        The registrar shall pay the contributions the registrar 178
receives pursuant to section 4503.68 of the Revised Code to the 179
great river council of the girl scouts of the United States of 180
America. The council shall distribute all contributions in an 181
equitable manner throughout the state to regional councils of the 182
girl scouts. 183

        The registrar shall pay the contributions the registrar 184
receives pursuant to section 4503.69 of the Revised Code to the 185
Dan Beard council of the boy scouts of America. The council shall 186
distribute all contributions in an equitable manner throughout the 187
state to regional councils of the boy scouts. 188

        The registrar shall pay the contributions the registrar 189
receives pursuant to section 4503.71 of the Revised Code to the 190
fraternal order of police of Ohio, incorporated, which shall 191
deposit the fees into its general account to be used for purposes 192
of the fraternal order of police of Ohio, incorporated. 193

        The registrar shall pay the contributions the registrar 194
receives pursuant to section 4503.711 of the Revised Code to the 195
fraternal order of police of Ohio, incorporated, which shall 196
deposit the contributions into an account that it creates to be 197
used for the purpose of advancing and protecting the law 198
enforcement profession, promoting improved law enforcement 199
methods, and teaching respect for law and order. 200

       The registrar shall pay the contributions received pursuant 201
to section 4503.712 of the Revised Code to Ohio concerns of police 202
survivors, which shall use those contributions to provide whatever 203
assistance may be appropriate to the families of Ohio law 204
enforcement officers who are killed in the line of duty. 205

       The registrar shall pay the contributions the registrar 206
receives pursuant to section 4503.72 of the Revised Code to the 207
organization known on March 31, 2003, as the Ohio CASA/GAL 208
association, a private, nonprofit corporation organized under 209
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 210
shall use these contributions to pay the expenses it incurs in 211
administering a program to secure the proper representation in the 212
courts of this state of abused, neglected, and dependent children, 213
and for the training and supervision of persons participating in 214
that program. 215

        The registrar shall pay the contributions the registrar 216
receives pursuant to section 4503.73 of the Revised Code to Wright 217
B. Flyer, incorporated, which shall deposit the contributions into 218
its general account to be used for purposes of Wright B. Flyer, 219
incorporated. 220

       The registrar shall pay the contributions the registrar 221
receives pursuant to section 4503.74 of the Revised Code to the 222
Columbus zoological park association, which shall disburse the 223
moneys to Ohio's major metropolitan zoos, as defined in section 224
4503.74 of the Revised Code, in accordance with a written 225
agreement entered into by the major metropolitan zoos. 226

       The registrar shall pay the contributions the registrar 227
receives pursuant to section 4503.75 of the Revised Code to the 228
rotary foundation, located on March 31, 2003, in Evanston, 229
Illinois, to be placed in a fund known as the permanent fund and 230
used to endow educational and humanitarian programs of the rotary 231
foundation. 232

        The registrar shall pay the contributions the registrar 233
receives pursuant to section 4503.85 of the Revised Code to the 234
Ohio sea grant college program to be used for Lake Erie area 235
research projects. 236

       The registrar shall pay the contributions the registrar 237
receives pursuant to section 4503.89 of the Revised Code to the 238
American red cross of greater Columbus on behalf of the Ohio 239
chapters of the American red cross, which shall use the 240
contributions for disaster readiness, preparedness, and response 241
programs on a statewide basis.242

       The registrar shall pay the contributions received pursuant 243
to section 4503.92 of the Revised Code to support our troops, 244
incorporated, a national nonprofit corporation, which shall use 245
those contributions in accordance with its articles of 246
incorporation and for the benefit of servicemembers of the armed 247
forces of the United States and their families when they are in 248
financial need. 249

       (C) All investment earnings of the license plate contribution 250
fund shall be credited to the fund. Not later than the first day 251
of May of every year, the registrar shall distribute to each 252
entity described in division (B) of this section the investment 253
income the fund earned the previous calendar year. The amount of 254
such a distribution paid to an entity shall be proportionate to 255
the amount of money the entity received from the fund during the 256
previous calendar year. 257

       Sec. 4503.524.  (A) The owner or lessee of any passenger car, 258
noncommercial motor vehicle, recreational vehicle, or other 259
vehicle of a class approved by the registrar of motor vehicles may 260
apply to the registrar for the registration of the vehicle and 261
issuance of power squadron license plates. The application for 262
power squadron license plates may be combined with a request for a 263
special reserved license plate under section 4503.40 or 4503.42 of 264
the Revised Code. Upon receipt of the completed application and 265
compliance with division (B) of this section, the registrar shall 266
issue to the applicant the appropriate vehicle registration and a 267
set of power squadron license plates with a validation sticker or 268
a validation sticker alone when required by section 4503.191 of 269
the Revised Code.270

       In addition to the letters and numbers ordinarily inscribed 271
thereon, power squadron license plates shall be inscribed with 272
words and markings selected and designed by the organization 273
Mansfield power squadron. The registrar shall approve the final 274
design. Power squadron license plates shall bear county 275
identification stickers that identify the county of registration 276
by name or number.277

       (B) Power squadron license plates and validation stickers 278
shall be issued upon payment of the regular license tax as 279
prescribed under section 4503.04 of the Revised Code, any 280
applicable motor vehicle tax levied under Chapter 4504. of the 281
Revised Code, a bureau of motor vehicles administrative fee of ten 282
dollars, the contribution specified under division (C) of this 283
section, and compliance with all other applicable laws relating to 284
the registration of motor vehicles. If the application for power 285
squadron license plates is combined with a request for a special 286
reserved license plate under section 4503.40 or 4503.42 of the 287
Revised Code, the license plates and validation sticker shall be 288
issued upon payment of the fees and taxes contained in this 289
division and the additional fee prescribed by section 4503.40 or 290
4503.42 of the Revised Code.291

       (C) For each application for registration and registration 292
renewal received under this section, the registrar shall collect a 293
contribution of fifteen dollars. The registrar shall transmit this 294
contribution to the treasurer of state for deposit into the 295
license plate contribution fund created in section 4501.21 of the 296
Revised Code.297

       The registrar shall deposit the ten-dollar bureau 298
administrative fee, the purpose of which is to compensate the 299
bureau for the additional services required in issuing power 300
squadron license plates, into the state bureau of motor vehicles 301
fund created in section 4501.25 of the Revised Code.302

       Section 2. That existing section 4501.21 of the Revised Code 303
is hereby repealed.304
