A BILL
To make an appropriation to continue to fund the 1
Special Supplemental Nutrition Program for Women, 2
Infants, and Children contingent upon a lapse in 3
federal funding. 4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. (A) As used in this section, "WIC" means the 5
Special Supplemental Nutrition Program for Women, Infants, and 6
Children established under the "Child Nutrition Act of 1996," 80 7
Stat. 885, 43 U.S.C. 1786, as amended.8

       (B) Contingent upon a lapse in federal funding, the Director 9
of Health shall certify to the Director of Budget and Management 10
the amount necessary to continue to fund the WIC program. The 11
amount shall be equivalent to the amount that otherwise would have 12
been received for the program for up to, but not more than, 13
twenty-five million dollars.14

       (C) Subject to division (B) of this section, there is hereby 15
appropriated from the Budget Stabilization Fund the amount 16
necessary up to, but not more than, twenty-five million dollars, 17
to continue to fund the WIC program. Authorization of this funding 18
expires when the federal government resumes funding operations.19

       Within the limits set forth in this act, the Director of 20
Budget and Management shall establish accounts indicating the 21
source and amount of funds for the appropriation made in this act, 22
and shall determine the form and manner in which appropriation 23
accounts shall be maintained. Expenditures from the appropriation 24
contained in this act shall be accounted for as though made in Am. 25
Sub. H.B. 59 of the 130th General Assembly.26

       The appropriation made in this act is subject to all 27
provisions of Am. Sub. H.B. 59 of the 130th General Assembly that 28
are generally applicable to such an appropriation.29

       Section 2.  Section 1 of this act is exempt from the 30
referendum under Ohio Constitution, Article II, Section 1d and 31
section 1.471 of the Revised Code and takes effect immediately 32
when this act becomes law.33
