A BILL
To enact sections 3701.66 and 3701.661 of the Revised 1
Code to provide for development of educational 2
materials promoting infant safe-sleeping practices 3
and for review of the materials with the parent, 4
guardian, or caregiver of each newborn infant. 5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 3701.66 and 3701.661 of the Revised 6
Code be enacted to read as follows:7

       Sec. 3701.66.  The department of health shall develop 8
educational materials that promote infant safe-sleeping practices 9
and discuss best practices to reduce the incidence of sudden 10
unexpected infant deaths, including sudden infant death syndrome. 11
In developing the materials, the department shall consider 12
information on these topics made available by the American academy 13
of pediatrics or a successor organization. The materials shall be 14
made available, free of charge, on the internet web site 15
maintained by the department. The department shall revise the 16
materials as necessary to ensure that the information in them is 17
current.18

       Sec. 3701.661.  (A) As used in this section:19

       (1) "Freestanding birthing center" has the same meaning as in 20
section 3702.141 of the Revised Code.21

       (2) "Hospital" means a hospital registered with the 22
department of health under section 3701.07 of the Revised Code 23
that contains a maternity unit licensed under Chapter 3711. of the 24
Revised Code.25

       (B) Beginning not later than one month after the department 26
of health develops the educational materials described in section 27
3701.66 of the Revised Code, each hospital and freestanding 28
birthing center shall arrange for a nurse or other appropriate 29
staff member to do both of the following prior to an infant's 30
discharge from the hospital or freestanding birthing center 31
following the infant's birth:32

       (1) Review, free of charge, the educational materials with 33
the infant's parent, guardian, or other caregiver;34

       (2) Provide to the infant's parent, guardian, or other 35
caregiver the internet address of the department's web site where 36
the educational materials are available.37

       (C) The nurse or other staff member who reviews the material 38
with the infant's parent, guardian, or other caregiver shall 39
include in the infant's medical record a notation specifying the 40
date and time that the review occurred.41
